AGREEMENT
THIS AGREEMENT, made and entered into this /0 0 day of

, 1968, by and between NELSON C. VOGEL and ELSIE M.
VOGEL, his wife. and MAURICE E. ROSS and NORMA G. ROSS, his wife,
hereinafter referred to as "0wner ", and the CITY OF CLEAR WATER,
FLORIDA, a municipal corporation, hereinafter referred to as IICityll;
WITNESSETH:
WHEREAS, the City of Clearwater requires property hereinafter
described for sanitary sewer easement purposes, and said Owner is willing
to grant such easement to the City under certain conditions;
NOW, THEREFORE, in consideration of the premises and other
good and valuable considerations, it is agreed as follows:
1. That the Owner agrees to grant unto the City of Clearwater, Florida,
a municipal corporation, an easement over the following described property:
A 15 foot permanent easement whose center-line is described
as follows: Begin at the NW corner of Section 7. Township 29
South. Kangelo ra:starid ruri t1'i.e'nce., oeuzps ItTT;---rzo. 43 feet
along the Section Line for P. O. B. ; thence N 89058 '00 II E, 52..80
feet; thence S 4701410911 E,.527. 79 feet; thence S 32024'4011 E,
314. 72 feet; thence S 83031 '1511 E, 153. 70 feet; thence S 56024'05 II E,
258.84 feet; thence S 48001'2511 E, 376.33 feet; thence S 63020'5511 E,
76.62 feet to point on the 40 a.cre line. said point lying S 001910111 W,
1188. 34 feet from the NE corner of NW -1/4 of NW -1/ 4 of Section
7. Township 29 South. Range 16 East for end of easement,
at and for the sum of Thirty-eight Hundred Dollars ($3800. 00); and the Owner
hereby agrees that said consideration shall be inclusive of all costs.
2. The City agrees to pay Owner the sum of Five Hundred Dollars
($500. OO) for his present disposal plant and the Owner will be allowed to
dismantle said disposal plant. retain the equipment therefrom.
3. The City further agrees to extend the sanitary sewer line under
the stream to facilitate connection of Owner's trailer park sewage system to
the City sanitary sewer system which said connection shall be at Owner's
expense.

4. The Owner shall be required to pay all customary monthly
charges for the use of said sanitary sewer service in accordance with the
schedule of fees established by the City of Clearwater after connection
thereto. In order to compute said service charges, the City will install
a water meter on Owner's trailer park pump and well and an additional
water meter will be installed on the water line to the small fountain in
the lake and the water from said additional meter will be deducted from
the total amount of water used. Said meters shall be installed at the expense
of the City.
5. Closing shall be on or before thirty (30) days from the date
hereof or as extended from time to time by mutual agreement.
6. This contract shall be binding on the heirs, successors and
assigns of the parties hereto.
IN WITNESS WHEREOF, the parties hereto have caused these presents
to be executed in their respective names, in duplicate, on the date first above
