AGREEMENT
THIS AGREEMENT, made and entered into this

day
of October, 1968, by and between BARNEY W. LAWS, a single man,
hereinafter referred to as "Owner", and the CITY OF CLEAR WATER,
FLORIDA, a municipal corporation, hereinafter referred to as "City";
WITNESSETH:
WHEREAS, the City of Clearwater requires property hereinafter
described for its sanitary sewer collection system, and said Owner is willing
to grant such easement to the City under certain conditions;
NOW, THEREFORE, in consideration of the premises and other
good and valuable considerations, it is agreed as follows:
1. The Owner agrees to grant unto the City of Clearwater, Florida,
a municipal corporation, a utility easement, as hereinafter set out, over
the following des cribed property:
A 15 foot wide easement for a sanitary sewer collection
system lying 7-1/2 feet each side of the following described
line: Begin at a point 190 feet South of the Northwest corner
of the Northeast 1/4 of the Northwest 1/4 of Section 7, Town-
ship 29 South, Range 16 East; thence run Easterly parallel with
the North line of said Section a distance of 451. 30 feet for a Point
of Beginning for said easement; thence run S 39041'45" W a
distance of 254. 35 feet; thence S 26022'45" W a distance of
302.76 feet; thence S 25042'15" E, a distance of 28. 00 feet to
the center line of a Creek or Branch being the end of the ease-
ment, said easement lying in the following described property:
Begin at a point 190 feet South of the Northwest corner of the
Northeast 1/4 of the Northwest 1/4 of Section 7, Township 29
South, Range 16 East; thence run Easterly parallel with the North
line of said Section a distance of 475 feet to a concrete monument;
thence continue on same course to centerline of Creek or Branch;
then Southwesterly along said Creek or Branch to the West line
of the Northeast 1/4 of the Northwest 1/4 of said Section; then
Northerly to a concrete monument on aforesaid line; continue
thence along aforesaid line 635 feet to a Point of Beginning, less
road right of way of County Road 32 and less that property
West of County Road 32.

2. The City agrees that Owner will be allowed to connect to the
sanitary s ewer being installed upon his property and the Owner agrees that
he will pay a 50% surcharge for the use of said sanitary sewer.
3. The Owner further agrees that when he is contiguous to the
City limits of the City of Clearwater that he will at once petition the City
Commission for annexation into the City of Clearwater.
4. This contract shall be binding on the heirs, successors and
assigns of the parties hereto.
IN WITNESS WHEREOF, the parties hereto have caused these
presents to be executed in their respective names, in duplicate, on the
date first above written.
