THIS FIRST AMENDMENT, Made and entered into on this 12t;R day of ~ ,l992, by and
between FLORIDA POWER CORPORATION ("GRANTOR"), and CITY OF CLEARWATER, FLORIDA, and
PINELLAS COUNTY, FLORIDA ("GRANTEES");

WHEREAS, by instrument dated April 28, 1981, subsequently recorded May I, 1981, in O.R. Book 5184
at Page 867 as Clerk's Instrument No. 81067684 of the Public Records of Pinellas County, Florida, said GRANTOR
and GRANTEES did enter into an E:lsement Agreement permitting GRANTEES to occupy and utilize a portion of
GRANTOR's electric transmission corridor for a roadway crossing (Stag Run Boulevard) with an 8-inch underground
water main and a lO-inrh underground sanitary sewer main beneath the roadway within a 6O-fnot wide Easement Area
as more particularly described in said Instrument No. 81067684; and
WHEREAS, said GRANTEES now desire that said Instrument No. 81067684 be amended to widen said
Easement Area to accommodate alterations to said roadway making it into two dead-end cul-de-sacs rather than a
through crossing, and GRANTOR is willing for said Instrument so to be amended.
NOW, THEREFORE, For and in further consideration of the sum of One Dollar ($1.00) and other good
and valuable considerations in hand paid by GRANTEES to GRANTOR, the receipt of which is hereby
acknowledged, GRANTOR and GRANTEES do hereby mutually agree to amend said Instrument No. 81067684 dated
April 28, 1981, and said Instrument is hereby amended, as follows:
That the legal description of the Easement Area as recited in said Instrument No. 81067684 is hereby
amended by deleting therefrom and thereout the present language in its entirety and inserting in lieu thereof the
following new language, to-wit:

A lOO-foot wide Easement Area lying within a certain segment
of GRANTOR's fee owned 236-foot wide transmission corridor
traversing a north/south course through the SE 1/4 of SE 1/4 of
Section 6, Township 29 South, Range 16 East, said lOO-foot
wide Easement Area being more particularly described as
follows:
Commence at the southwest corner of SE 1/4 of SE 1/4 of
Section 6, Township 29 South, Range 16 East, Pinellas County,
Florida, and run thence N.OIO 16'47"E., along the west
boundary of said SE 114 of SE 1/4 of Section 6 (being also the
west boundary of GRANTOR's transmission corridor as
described in Warranty Deed recorded in O.R. Book 1466 at
Page 157 as Clerk's Instrument No. 969718A of the Public
Records of Pinellas County, Florida), for 462.57 feet to the
Point of Beginning; continue thence N.Olo 16'47"E., along said
west boundary, for 100.00 feet; thence S.88043'13"E. for 232.92
feet to a point on the east boundary of GRANTOR's
transmission corridor; thence S.Olo 12'20"W., along said east
boundary, for 100.00 feet; thence N.88043'13"W. for 233.00 feet
to the Point of Beginning.

incorporated herein and made a part hereof.
Except as hereinabove amended, the aforesaid Easement Agreement dated April 28, 1981 and
recorded as Clerk's Instrument No. 81067684 shall, in all other respects, remain in full force and effect upon the
original terms and conditions therein expressed.
IN WITNESS WHEREOF, the aforesaid GRANTOR and GRANTEES have caused this First
Amendment to be signed in their respective names by their proper executive officers or officials thereunto duly
authorized and their respective official seals to be hereunto affixed and attested all as of the day, month and year first
