EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1.00) cash in hand
paid to them, the receipt of which is hereby acknowledged, and the benefits to
be derived therefrom, JOHN A. SIMPSON and BETTY L. SIMPSON, his wife, do hereby
grant and convey to the CITY OF CLEARWATER, FLORIDA, a non-exclusive underground
easement, to be used in common, over, under and across the following described
land, lying and being situate in the County of Pinellas, State of Florida, to
wit:
The West ten (10) feet of the following legally described property: A portion
of Lot 14, CLEARWATER INDUSTRIAL PARK, as recorded in Plat Book 44, page 46,
Public Records of Pinellas County, Florida, and more particularly described as:
Beginning at the Southeast corner of Lot 14, CLEARWATER INDUSTRIAL PARK, as
recorded in Plat Book 44, page 46, Public Records of Pinellas County, Florida,
said point also being on the Northerly right of way line of S.C.L. Railroad
right of way; thence N 72 degrees, 45'05" W., along said line, 293.30 feet;
thence N 00 degrees 04'51" W., 799.49 feet to a point on the Southerly right of
way line of Logan Street (a 60' right of way); thence S 89 degrees 25'56" E.
along said line 15.00 feet; thence S 00 degrees 04'51" E., 300.00 feet; thence S
89 degrees 25' 56" E., 265.00 feet to a point on the Wes t right of way line of
Belcher Road; thence S 00 degrees 04' 51" E., along said line 583.68 feet to the
point of beginning.
~~iS easement being for underground drainage and underground utility
instal~~ation and maintenance and will not interfere with the ability of SIMPSON
or their assigns to use the same property for the same purposes, including, but
not limited to, connecting to existing sewer line and construction, maintenance
and perpetual use of roadway along with landscaping, curbing and related usage.
The CITY OF CLEARWATER, FLORIDA, shall have the right to enter upon the
above-described premises and to construct, install and maintain thereon any
underground drainage and underground utility lines and to inspect and alter such
drainage and utility lines from time to time. The CITY OF CLEARWATER, FLORIDA,
in its use of this easement, will pay for and repair the underground utilities
and shall also pay for any and all costs associated with or caused by the CITY'S
use.
