SPECIAL WARRANTY DEED
THIS INDENTURE, made this 22nd day of June, 1981, between U. S.
HOME CORPORATION, a Delaware corporation, as Grantor, and THE CITY
CLEARWATER, a Florida municipal corporation, whose mailing address

WITNESSETH:
That the Grantor, for and in consideration of TEN AND NO/IOO
DOLLARS ($10.00) and other good and valuable consideration, the
receipt of which is hereby acknowledged, has granted, bargained and
sold to Grantee, its successors and assigns forever, that certain real
property in Pinellas County, Florida, more particularly described on
Exhibit A attached hereto and incorporated herein by reference (the
"Property") .
SUBJECT TO taxes and assessments for 1981 and subsequent years,
and all easements, reservations, agreements and restrictions of
record, and to the reverter condition and reserved easements
hereinafter set forth.
Grantor does hereby covenant with Grantee that except as noted
above, at the time of delivery of this Deed, the property was free
from all encumbrances made by Grantor, and Grantor will warrant and
defend the same against the lawful claims and demands of all persons
claiming by, through and under Grantor, but against none other.
This conveyance is made subject to the express condition, which
shall be a covenant and condition running with the land, that the
Property conveyed be maintained and used, subject to existing ease-
ments or those hereafter reserved, only for the purpose of a public
~ark and recreation area, and in the event Grantee, its successors or
~pssigns should violate this condition, title to the Property shall be
~orfeited and every right and interest therein shall immediately
.. ~ 00 ~t.hereupon revert and vest in Grantor, its successors and assigns,
~ ~ ;! ...without further action or re-entry by Grantor, its successors or

~ ~ ~ ~ GRANTOR HEREBY SPECIFICALLY EXCEPTS AND RESERVES unto itself, its
~5~~successors and assigns, a non-exclusive, assignable easement for
, ~~drainage over, under, on and across the Property. This reservation of
~easement shall not impose any obligation on Grantor to maintain such
~easement area or to install or maintain any swales or drainage facili-
Uties located therein or thereon, but Grantee, by its acceptance and
recording of this Deed agrees to maintain continuously such swales and
facilities. The easement rights reserved by Grantor may hereafter
from time to time be assigned by U. S. Home Corporation, in whole or
in part, and on a non-exclusive basis for the benefit of such other
lands, and to such entities, including public bodies, as Grantor may
determine necessary or appropriate.
