AMENDMENT TO RESTRICTIONS
KNOW ALL MEN BY THESE PRESENTS that WHEREAS, Dalip O.
Tzekas and Rabija Tzekas, his wife, and Vasilij e Popovic xxlll~x:NMxxx
~:~{}htx~ibe, as owners in fee simple of the following described real
property situate in Pinellas County, Florida:
Lots One (1) through Eleven (11), Block 6, Brookwoo d
Terrace, Revised Plat, according to the map or plat thereof
as recorded in Plat Book 8, page 34 of the Public Records
of Pinellas County, Florida,
on July 23, 1974, executed certain restrictive covenants restricting and
limiting the use of said described real property; and
WHEREAS, said restrictive covenants were recorded on August 2,
1974, in O. R. 4200, page 1567, of the Public Records of Pinellas County,
Florida; and
WHEREAS, said owners and the City of Clearwater are des irous
of amending ,said restrictive covenants;
NOW, THEREFORE, the undersigned, Dalip O. Tzekas and Rabija
Tzekas, his wife, and Vasilije Popovic :~UU~l:~K~X~~~~~
as fee simple owners, and the City of Clearva ter, Florida, a municipal
corporation, in consideration of the foregoing and other good and valuable
considerations, receipt of which is hereby acknowledged, do covenant and
agree as follows:
1. That restrictive covenant #4, as contained in said original
Restrictions as recorded in O. R. 4200, page 1567, of the Public Records
of Pinellas County, Florida, is hereby amended to read as follows:
"4. At any time hereafter when the Cit y s hall in writing
notify said Owners, then the Owners shall, at_ their
expense, install, provide and maintain appropriate
fencing at a minimum height of six (6) feet along the
West and South boundaries of the subject property
which said fencing shall be interspersed with shrubs
and trees. "
2. The parties hereto hereby ratify and reaffirm all of the remaining
restrictive covenants and provis ions as contained in said original Restrictions

shall be perpetual and shall apply to and be forever binding upon the owners,
their grantees, heirs, executors, administrators, successors and assigns,
and all parties dEriving any title to the premis es or the right to the us e
and occupancy thereof by, through or under them, and the Owners hereby
covenant and agree to indemnify, protect and save the City of Clearwater
harmless from all claims by anyone, including reasonable attorney IS fees, in
connection therewith.
