AGREEMENT
THIS AGREEMENT, made and entered into this
/ 1 ~ day of
August, A.D. 1971, by and between PARK SQUARE, INC., a Florida
corporation, hereinafter referred to as "Owner", and the CITY OF
CLEARWATER, FLORIDA, a municipal corporation, hereinafter referred
to as "City";
WITNESSETH:
WHEREAS, the Owner presently OWns certain real property in
Hibiscus Gardens Subdivision, Clearwater, Pinellas County, Florida; and
WHEREAS, the Owner has requested the City to vacate a certain
portion of platted right of way for Lady Mary Drive and Stevenson Boulevard
which is not being used; and
WHEREAS, the City is willing to vacate a portion of said streets
under certain conditions;
NOW, THEREFORE, in consideration of the foregoing premises and
other good and valuable considerations, receipt of which is hereby acknowledged,
the parties hereto covenant and agree as follows:
1. The Owner agrees that it will, at its expense, construct paving,

59 of the Public Records of Pinellas County, Florida.

This paving will be done to City standards and with the approval of the City
Enginee r.
2. The Owner further agrees that it will give to the City an easement
for utility and drainage purposes to serve its property and will, at its expense,
relocate the sanitary sewer line necessary for this project in accordance

with plans on file with the City Engineer.
3. This Agreement shall run with the land and shall be binding upon
the heirs, administrators, pers onal representatives, success ors and assigns
of the parties hereto and a copy thereof may be immediately filed in the Public
Records of Pinellas County, Florida, by the City so as to serve as notice
thereof to all other persons.
