Commjssion.t:J\pires $'\Y 14, jWl -' .......t ~. ..:...... /', ., '/... .' /.l. -O/~-03 (1) "------ a..;.~-....,": I , :..- AGREEMENT THIS AGREEMENT, made and entered into this 31../ day of ~A.D. 1973, by and between LEHMANN PROPERTIES, INC., a Florida corporation, hereinafter referred to as 'ILehmann", and the CITY OF CLEAR WATER, FLORIDA, a municipal corporation, hereinafter referred to as "City I; WITNESSETH: WHEREAS, Lehmann is the fee simple title owner of certain real property within the City of Clearwater, Florida, which is necessary for the extension of Laura Street within said City limits; and WHEREAS, the City of Clearwater desires to vacate a portion of Northeast Cleveland between Greenwood and Laura Street extended, subject to certain conditions and terms to be performed by Lehmann; NOW, THEREFORE, in consideration of the foregoing premises and other good and valuable cons ideration, receipt of which is hereby acknowledged, the parties hereto covenant and agree as follows: 1. Lehmann hereby covenants and agrees to the following: a. To deed 60 feet for right-of-way for this project upon final agreement between the parties. b. To pay up to $16,000.00 toward the cost of construction of the exten- sion of Laura Street. c. To convey an additional ten foot of right-of-way along Greenwood Avenue from Cleveland Street to Laura on the East side of said Greenwood A venue. d. To convey ten feet of right-of-way along the North side of Laura from Greenwood to Booth Street. e. To convey ten feet of right-of-way along the West side of Greenwood from Laura Street to Grove along the school property. f. To convey a right-of-way easement at the Northwest corner of Greenwood-Cleveland intersection (Heart of Clearwater Motel) and at South- east corner of intersection (Ponderosa Steak House) for sidewalk and realign- ment in exchange for vacated, right-of-way on said Northwest corner. f" -1- ~ /~;', ~.-I' ,I , 2. The City hereby covenants and agrees to the following: a. To install a traffic signal at the intersection of Laura Street and Greenwood Avenue. b. To vacate that portion of Northeast Cleveland between Greenwood and Laura Street, extended, subject to retaining an easement for existing utilities. It is understood that the vacated area is to be used as parking facilities. 3. This Agreement shall be binding upon the successors and assigns of the parties hereto.
