of the Missouri Avenue right-of-way project and is only half of this
particular purchase. The W. 20 ft. of Lot 1 for the purchase price of
$22.500 will be completed when a release of the mortgage covering this
property has been received. Enclosed herewith are the following:
Warranty Deed dated November 5. 1979. executed
by 310 Missouri Inc.. together with check for documentary
stamps in the amount of $72.00

AND SALE OF REAL ESTATE

THIS AGREEMENT, made and entered into this

, A. D. 1979, by and between 310 SOUTH MISSOURI, INC.,
a Florida corporation, hereinafter referred to as Seller, and the CITY OF
CLEARWATER, FLORIDA, a municipal corporation, hereinafter referred
to as Purchaser;
WITNESSETH:
That in consideration of the mutual promises and covenants herein
contained and other valuable considerations passing between the parties
hereto, the Seller agrees to sell and the Purchaser agrees to buy the following
described real property situate, lying and being in Pinellas County, Florida,
to wit:
The West 20 feet of Lots 1 and 26 of Revised Block 5
of Original Block 5 of R. H. Padgett Subdivision, according
to the map or plat thereof as recorded in Plat Book 4,
pages 32 to 41 of the Public Records of Pinellas County,
Florida.
The total purchase price of said property shall be the sum. of
Forty Thousand Five Hundred Dollars ($40,500.00), payable in full upon
closing, which shall be on or before sixty (60) days from date hereof at the
office of the City Attorney, Clearwater City Hall, 112 S. Osceola Avenue,
Clearwater, Florida.
IN CONSIDERATION WHEREOF, Seller agrees to convey said
property to said Purchaser by good and sufficient Warranty Deed, with fee
simple, marketable title, free and clear of all encumbrances of record.
Subject real property is to be used for right-of-way for Missouri
Avenue and Seller shall be permitted to continue parking on the present
parking lot being purchased as right-of-way until construction is started on
Missouri Avenue widening.

Purchaser agrees that a left turn will be permitted from Missouri
Avenue, Northbound, into Gould Street, Westbound.
Purchaser further agrees that Seller may use Lot 6 of Block 5, R. H.
Padgett Subdivision Revised, for parking a minimum of thirteen (13)
automobiles.
Purchaser agrees to pay all closing costs except the taxes for 1979
will be prorated as of date of delivery of possession.
Both parties agree that neither have used the services of a real
estate broker in this transaction and no brokerage fee is due anyone.
The obligations and benefits under this contract shall extend to the
personal representatives, heirs, successors and assigns of the parties
hereto.
IN WITNESS WHEREOF, the parties hereto have set their hands and
seals the day and year first above written.
