Excerpt from Minutes of February 20, 1956
itA letter was read from Judge John U. Bird stating that he was the
owner of Lot Onef Block Af Fairview Additionf which on the original plat
shows dimentions of 140 feet North and South and 90 feetf plus 17 feet
East and Westf making a total dimension of Lot one 107 feet East and
West. The letter explained that the City recorded a quit claim deed
from Mr. B. C. Bass to a strip of land 17 feet wide lying between
Brookwood Terrace Subdivision and Fairview Additionf which is clouding
his title to Lot One; thereforef the letter requested that the City
quit claim to him the 17 foot strip covered by this deed as to Lot Onef
Block A. It was the City Attorney's opinion that the deed from B. C.
Bass might be good for the part in the rear of Lot One but he did not
believe it was good for the part adjacent to Lot One. The City Attorney
reported that the City Engineer had stated that the seventeen feet
adjoining Judge Bird'~ property was not necessary to the City for
drainage purposes. It was noted by the Commissioners that only a
twenty-five foot right of way was dedicated by the plat of Fairview
Addition to Drew Street and it was suggested that Judge Bird might be
willing to exchange an eight foot dedication on the north side of Lot
One for the desired quit claim deed to the seventeen feet on the west
of Lot One. Commissioner Strang moved that the proper officials be
authorized to execute a quit claim deed for this property of the seven-
teen feet as requested in JudggeBird's letter in exchange for return
of a deed for right of way for eight feet extending along in an east-
west direction on the northern boundary of his property for right of way
purposes only. Motion was seconded by Commissioner Roberts and carri,,'d
unanimously."
