RESTRICTIONS
WHEREAS, Metz and White, Inc., a Florida corporation, is the
owner of the following real property situate, lying and being in the County
of Pinellas and State of Florida, to wit:
South 18. 75 feet of Lot 3, Block B, Drew Heights
Subdivision, according to the map or plat thereof
as recorded in Plat Book 11, page 101 of the Public
Records of Pinellas County, Florida;
and
WHEREAS, Metz and White, Inc. desires to place certain restrictions
upon said property, which shall be covenants running with the land, for the
protection of itself, persons and corporations purchasing said property from
it or its assigns, the general public, and the City of Clearwater, Florida, a
municipal corporation;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that
in consideration of the foregoing premises and other good and valuable
consideration, receipt of which is hereby acknowledged, the undersigned,
Metz and White, Inc., as owner of the above described real property, does
hereby adopt and promulgate the following restrictive covenants concerning
said described real property:
1. These restrictions and limitations are to be regarded as covenants
running with the land, regardless of whether they are specifically mentioned
in any deeds or conveyances subsequently executed.
2. The Owner shall immediately, at its expense, improve Tulane
Avenue by grading same and laying a shell base thereon on the portion of
the dedicated right of way of Tulane Avenue from Drew Street to the North
boundary of the subject property.
3. The Owner shall, at its expense, immediately erect a solid six
foot (6') fence of redwood material or equivalent along that portion of the
West property line of said property which is not occupied by a building or
structure.
4. There shall be no electrical or water utility service furnished to
the site of the subject property or to any structures or improvements erected
on the subject property.
5. All building plans and specifications for the improvement of subject
property or the erection of any structures thereon shall be in accordance with
the terms and provisions of these restrictions and covenants.
6. These covenants and restrictions shall be binding on all par_ties
and all persons claiming under them, and no exception, variation or termination
of these restrictions shall be authorized or effective without the prior written
consent of the City of Clearwater.

well known to me to be the President and Secretary respectively of the
corporation named as OWner in the foregoing instrument, and that they
