Brooking, his wife, are the owners of the following real property situate, lying and being in the County of Pinellas and State of Florida, to wit: North 356 feet of Lot 2, Replat of Lakewood Subdivision, according to the map or plat thereof as recorded in Plat Book 20, page 41 of the Public Records of Pinellas County, Florida; and WHEREAS, Frank W. Brooking and Annette M. Brooking, his wife, desire to place certain restrictions upon said property, which shall be covenants running with the land, for the protection of themselves, pers ons and corporations purchasing said property from them or their heirs, executors or assigns, the general public, and the City of Clearwater, Florida, a municipal corporation; NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that in consideration of the foregoing premises and other good and valuable consideration, receipt of which is hereby acknowledged, the undersigned, Frank W. Brooking and Annette M. Brooking, his wife, as owners of the above described real property, do hereby adopt and promulgate the following restrictive covenants concerning said described real property: 1. These restrictions and limitations are to be regarded as covenants running with the land, regardless of whether they are specifically mentioned in any deeds or conveyances subsequently executed. 2. The maximum height of any structure erected on said above described property shall not exceed three (3) stories. 3. In the development and improvement of said property, at no time shall efficiency apartment units exceed one-third (1/3) of the total number of apartment units erected on the above described property. 4, All building plans for the improvement of subject property shall be in accordance with the terms and provisions of these restrictions and covenants. 5. These covenants and restrictions shall be binding on all parties and all persons claiming under them, and no exception, variation or termination of these restrictions shall be authorized or effective without the prior written consent of the City of Clearwater.
