NOW THEREFORE BE IT RESOLVED that the said property be and the same is hereby dedicated as a public park to be used for park purposes only, and shall be known as Crest Lake Park. Barry Mr. Barry introduced the following resolution: WHEREAS, all phases of the work covered by Section "I" Cameron and Barkley Company, Gas Compressor, are substantially complete according- . to original plans and specifications ~~d approved change order and per- formance test shows both capacity and economy performancebett0r than contract requirements, as per performance test attached hereto. .; 0.. THEREFORE, BE IT RESOLVED BY THE CITY CO},'IMISS ION OF THE CITY OF CLEARWATER, FLORIDA, IN MEETING ASSEMBLED: That the City Manager be and he is hereby authorized and instructed to accept as being substantially complete according to original plans and specifications and approved change order all phases of the work covered by Section "I" Cameron and Barkley Company, Gas Compressor. Floyd, City Manager CITY CLERK Apparent Resolution Involving Crest Lake Park October 6, 1976 A purported resolution of the City Commission of the City of Clearwater dated December 12, 1938, purportedly involving the use that can be made of Crest Lake Park has been circulated. The question arises with respect to the language contained in the purported resolution which specifies that the Park be dedicated to public park use only. :From the materials presented, it appears that the City Commission itself in December of 1938 sought to impose a restriction on the use that could be niade of the park now known as Crest Lake Park. The question that arises involves whether or not this purported restriction placed on the property by that City Commission is effective to bar a subsequent City Commission from utilizing the property for another but different or possibly different public use. The general rule normally recognized by municipalities in the use of property is set out in McQui1linMUn~ Cori'-~ (3rd Ed. ) Section 28. 24, wherein the author s point out as follows: "*****It is the general rule that, unless the property has been dedicated to a use which has not been abandoned, the fact the property is acquired by a City for a certain declared purpose and so used does not deprive the City of power to use the premises for other public purposes." See also Pearlman v. Anderson, 307 N. Y.S. 2d 1014. The question is further complicated by reason of the fact that in certain situati namely, where a private owner or ln some cases another government dedicate land to a governmental entity for a specific purpose, such a. dedication when properly accepted is effective to place a restriction on the use of the land sud as will interfere with the changing of such use to another public use. This concept is explained by the author in McQ\li.Uin'MWi.-Corp. If property is dedicated to a particular purpose', it cannot be diverted therefrom by the state or municipality except under the power of eminent domain. Where, however, dedication is made by the state, the intention of the state controls the use, and the state may change the original use for other public uses. And, furthermore, where the public, as distinguished from a private owner, is the dedicator the grant generally speaking will be deemed to be unrestricted or if restricted will be less rigidly construed. ***>:<***;'< To constitute misuser or diversion, the use made of the dedicated property must be inconsistent with the purposes of the dedication or substantially interfere with it. " It is generally recognized that the intent of the dedicator of land must be clearl) and unequilrocally manifested. Dedication is not presumed. McQuillin Mim. Corp. (3rd Ed. ) Section 33. 37 and Section 33.38. The problem which arises in the instant situation surrounds the purported resolution and the language contained therein. The language of the resolution is not supportive of a conclusion that the private property owner transferring the property to the City was doing so in the form of a dedication or utilizing language intending to impose a restriction on the USe of the land. The language is more supportive of a conclusion that the City COmmission itself sought to impose such a restriction on the land as would prevent future City COmmissions from changing the use to some more public Use. Therefore, it appears from the information presented that a true dedication has not Occurred in this case. That instead a previous City COmrnis sion has attempted to act in such a way as to bind a future City Commission in the general public use of property possessed by the City. In the absence of further documentation demonstrating a true effective dedication passing to the City from a private or other governmental entity and acceptance of that dedication by the City, it would be my opinion that the subject resolution would not be effective to bind the present City COmmission in its determination with respect to the use that should be put of the property~-- (// )./7 /~-j;2~~ TAB:br City Attorney ~ " I ....-..,............-'.!l~ ~ ITEM 110 City Mana~er Reports Library Site Analysis Report. The City Manager reviewed the requirements of the Public Works Act and reported the money had not yet been allocated. The City will probably submit their ~pplications for funds in about two weeks. A Libary Site Analysis dated September 30, 1976, Was prepared by the Staff and stated three basic questions must be answered for each site to be given consideration: I, it must be large enough; 2, the Strength and weaknesses of this site relative to the alternatives; and 3, the effect on the environment by construction on the site. The following six sites were considered: 1. The existing Library site. 2. City Hall parking lot On Osceola. 3. Tennis court and old auditorium site. 4. Crest Lake. .f~~ 5. City Hall Annex. 6. Starcrest. The City Manager requested that site number two, the City&ll parking lot on Osceola, be withdrawn. The other sites were throughly discussed and slides shown of the areas. The City Manager read into the record a letter dated October 7, 1976, from Olsen, Purdum & White, Inc., structural engineers in St. Petersburg, Florida, stating that the pres- ent library building is structurally safe. A second floor could be safely added but would require "beefing up" of the first floor and additional supplementary floor joists. A number of citizens spoke in favor and in oPposition to the various sites. Jim Bowman presented a petition with approximately 1,000 signatures in oPposition to a library at Crest Lake Park. The majority of the citizens speaking on Crest Lake Park requested it be kept as a park and not be used for a library. There were no citizen Comments on the old auditorium site Or the Starcrest site. James Taft spoke in favor of the Annex stating it was a good area and a strong building and recommended all departments of the City be in one place by building an addition to City Hall. Commissioner Carwise moved that the library be located on Site II, the Site of the existing library. Commissioner Frank seconded the motion and commented on the one criterion that vas not included in the data sheet: "for maximum use a Site should have pedestrian traffic generators in the immed- iate vincinity." Commissioner DeBlaker stated ~he supports the overall concept of a main library and branches but had Concerns about the operating costs, sufficient parking, and thzt it be in a convenient location for the people. Upon the Vote being taken, Commissioners Carwise, Martin and Frank, and the Mayor voted "Aye"; Commissioner DeBlaker voted "Nay."
