THE PRUDENTIAL HOME MORTGAGE COMPANY, INC., a corporation
organized and existing under the laws of the state of Illinois,
with its principal office at 3200 Robbins Road, Springfield, County
of Sangamon , State of Illinois, 62794-9488, for $1.00 and
other good and valuable consideration, the receipt of which is
acknowledged, hereby releases the property situated in the County
of Pinellas, State of Florida, described as follows:
A portion of Lot 1, Block A, CREST LAKE PARK SUBDIVISION,
as more particularly described in Exhibit "A" and depicted
in Exhibit "B" attached hereto and made a part hereof.
from the lien of that certain mortgage owned and held by such
corporation, given on that and other real property on December 15
1994, executed by Kelly A. Cantin, a married woman joined by her
spouse, David L. Cantin, mortgagor, to Crossland Mortgage
Corporation, mortgagee, and recorded December 16, 1994, in the
office of the Clerk of the Court of Pinellas County, Florida, in
Official Records Book 8867, Page 2390, given as security for
payment of that certain Note of even date described therein for the
sum of Forty Eight Thousand Five Hundred Sixty Eight and--NOjlOO's-
-Dollars ($48,568.00).
Additionally, in consideration of such payment, such corporation
hereby remises, releases, and forever quitclaims to the City of
Clearwater, Florida, its s~ccessors and assigns, to the mortgagor
and to the successors and assigns of mortgagor, the above described
premises, together with all tenements, hereditaments, and
appurtenances thereto belonging; but it is expressly stipulated and

PURCHASE AGREEMENT

THIS AGREEMENT is made between DAVID L. CANTIN and KELLY A. CANTIN, husband
and wife, 1501 Cleveland Street, Clearwater, Florida 34615-6002 (herein
"Seller"), and the CITY OF CLEARWATER, FLORIDA, a Florida Municipal
Corporation (herein "Buyer" or "City").
WITNESSETH
For and in consideration of the mutual covenants and conditions herein
contained, Seller hereby agrees to sell and Buyer agrees to buy the following
property or interest therein, upon the following terms and conditions:

I. DESCRIPTION
(a) Real estate or interest therein, identified as Parcel No. 6 as
shown on right-of-way maps of Highland Avenue, being a portion of
Lot 1, Block A, CREST LAKE PARK SUBDIVISION, as more particularly
described in Exhibit "A" and depicted in Exhibit "B" attached
hereto and by reference made a part hereof.

II. PURCHASE PRICE
Amount to be paid by Buyer to Seller at closing......$ 250.00
III. CONDITIONS AND LIMITATIONS
(a) In addition to the PURCHASE PRICE to be paid as above described,
the City, at City expense, shall construct in compliance with
applicable city codes, either a landscaped soil berm, or a pre$sure
treated wood or masonry buffer structure generally as depicted in
the ADDENDUM attached hereto. The structure shall be located
upon Seller's property southeasterly of the boundary of the parcel
being acquired. The Seller shall have final approval of such berm
or buffer, vlhich shall not be unreasonably withheld. The City
shall also pay the cost of updating Seller's current boundary
survey performed by William C. Keating of Allied Engineering &
Surveying.
(b) Seller agrees to indemnify and save the City harmless from all
claims (including costs and expenses of defending against such
claims) arising or alleged to arise from any act or omission of
of the city, its agent~, employees or contractors, and from all
claims for any damage or injury incurred during fulfillment of
City obligations herein described.
(c) No actual or estimated ad valorem taxes shall be prorated to
Buyer or collected from Seller at time of closing this
transaction.

(d) Seller shall deliver unencumbered title to Buyer at closing;
however, Buyer shall, at Buyer's sole cost and expense, have the
obligation to obtain any releases of encumbrances as Buyer may
require.
(e) Seller authorizes, and the city agrees, to restore to the present
or equal condition any of Seller's remainder property, specific~lly
including the area wherein the berm or buffer structure shall be
constructed, that may be disturbed or impacted during construction
of the right-of-way improvements. Such restoration shall be
accomplished at city expense and shall be completed not later
than project completion.
(f) It is mutually understood that this Agreement is executed by the
Seller subject to final acceptance by the city Engineer of the
City of Clearwater, which ,shall occur within five (5) business
days of receipt of this document in the office of the City
Engineer, executed in duplicate by Seller. Date of acceptance
and execution by the City Engineer shall be the Effective Date of
this agreement, and execution shall serve to ratify and confirm
the purchase price and all terms and conditions as are contained
herein. If this agreement is not timely accepted and executed by
the City Engineer, Seller may, at Seller option, withdraw from
this agreement by providing written notice of such intent to the
office of the city Engineer, whereupon this agreement shall
thereafter be null and void in all respects.
IV. CLOSING DATE - POSSESSION
This transaction shall be closed and the Seller shall cOnvey
title by Special Warranty Deed within sixty (60) days of the
Effective date of this agreement.

person in possession who has any right in and to the aforesaid property.
