PARTIAL RELEASE OF MORTGAGE
(Corporate Mortgagee)
AVCO FINANCIAL SERVICES OF HOLLYWOOD, FLORIDA, INC., a
corporation organized and existing under the laws of the state of
Florida, mortgagee, with offices at 829 Douglas Avenue, Altamonte
springs, Florida 32714, for $1.00 and other good and valuable
consideration, the receipt of which is acknowledged, hereby
releases the property situated in the County of Pinellas, State of
Florida, described as follows:
That portion of Lot 1, A Replat of Block A, OAK HILLS
SUBDIVISION, as recorded in Plat Book 26, Page 5 of the
Public Records of pinellas County, Florida, being further
described as in EXHIBIT "A" and depicted in EXHIBIT liB"
attached hereto and made a part hereof,
from the lien of that certain mortgage owned and held by said
corporation received January, 1996 by assignment from Crown Bank,
a Federal savings Bank, 105 Live Oak Gardens, Casselberry, Florida
32707, given on that and other real property on October 11, 1995,
executed by John Alfred Moore and Lucille Isabel Moore, his wife,
mortgagor, to Crown Bank, and recorded October 18, 1995, in the
office of the Clerk of the Court of pinellas County, Florida, in
Official Records Book 9138, Pages 908 through 912, given as
security for payment of that certain Note of even date described
therein for the sum of Ten Thousand and --NOj100's--Dollars
($10,000.00) .
Additionally, in consideration of such payment, said corporation
hereby remises, releases, and forever quitclaims to the CITY OF
CLEARWATER, FLORIDA, its successors and assigns, to the mortgagor
and to the successors and assigns of mortgagor, the above described
premises, together with all tenements, hereditaments, and
appurtenances thereto belonging; but it is expressly stipulated and
agreed that the mortgage is and shall be in full force and effect
as against all the property described therein except the parcel or
parcels herein released.

Corporation (herein "Buyer" or "City").

For and in consideration of the mutual covenants / and conditions herein
contained, Seller hereby agrees to sell and Buyer agJees to buy the following
property or interest therein, upon the following terms and conditions:
I. DESCRIPTION
(a) Real estate or interest therein, identified as Parcel No. 16 as
shown on right-of-way maps of Highland Avenue, being a portion of
OAK HILLS REPLAT, Lot 1, as more particularly described in Exhibit
"A" and depicted in Exhibit "B" attached hereto and by reference
made a part hereof.

(b) Personal property to be conveyed: Ferns & scrubs, other than
Palms, which are to be relocated as described in Paragraph III (a).
II. PURCHASE PRICE
Amount to be paid by Buyer to Seller at closing......$ 250.00
III. CONDITIONS AND LIMITATIONS
(a) In addition to the PURCHASE PRICE to be paid as above described,
the city shall relocate the Sable Palm trees located within the
boundaries of Parcel No. 16, or in close proximity thereto, to
an area abutting and southeasterly of the parcel to be conveyed.
(b) Seller agrees to indemnify and save the City harmless from all
claims (including costs and expenses of defending against such
claims) arising or alleged to arise from any act or omission of
of the City, its agents, employees or contractors, and from all
claims for any damage or injury incurred during fulfillment of
City obligations herein described.
(c) No actual or estimated ad valorem taxes shall be prorated to
Buyer or collected from Seller at time of closing this
transaction.
(d) Seller shall deliver unencumbered title to Buyer at closing;
however, Buyer shall, at Buyer's sole cost and expense, have the
obligation to obtain any releases of encumbrances as Buyer may
require.

(e) Seller authorizes, and the city agrees, to restore to the present
or equal condition any of Seller's remainder property up to but
not more than five feet (5') abutting the parcel being conveyed
that may be disturbed or impacted during construction of the
right-of-way improvements. Such restoration shall be
accomplished at City expense and shall be completed not later
than project completion.
(f) It is mutually understood that this Agreement is executed by the
Seller subject to final acceptance by the City Engineer of the
City of Clearwater, which shall occur within five (5) business
days of receipt of this document in the off ice of the city
Engineer, executed in duplicate by Seller. Date of acceptance
and execution by the City Engineer shall be the Effective Date of
this agreement, and execution shall serve to ratify and confirm
the purchase price and all terms and conditions as are contained
herein. If this agreement is not timely accepted and executed by
the City Engineer, Seller may, at Seller option, withdraw from
this agreement by providing written notice of such intent to the
office of the City Engineer, whereupon this agreement shall
thereafter be null and void in all respects.
IV. CLOSING DATE - POSSESSION
This transaction shall be closed and the Seller shall convey
title by Special Warranty Deed within forty-five (45) days of the
Effective date of this agreement.
V. TYPEWRITTEN OR HANDWRITTEN PROVISIONS
Typewritten or handwritten provisions inserted herein or attached
hereto as addenda, and initialed by the parties, shall control
all printed provisions in conflict therewith.
