(4) If the death sentence Is Imposed and affirmed on appeal to the Supreme
Court, the appointed attorner shall beanowed reasonable Compensation Dot to
exceed $1,000 for attorneys' fees and costs incurred in representing the defend-
ant as to an application for executive clemenC7, such compensation to be paid
out of general revenue from funds budgeted to the Department of Offender
Rehabllltation.; The publlc defender or an attomer appointed pursuant to this
section may be appointed by- the trial court that rendered the judgement im-
posing thedeatb penalty, to represent an Indigent defendant who has applied
for executive clemenC7 as relJef from the exeCution of the judgement imposing

(5) All compensation and costs, except as provided in subsection (4), provided
for In this section shall be paid by the county in which the trial is held UDless'
the trial was moved to that county on the ground that a fair and Impartial
trial could not be held in another county, in which event the compensation and

SectIon 1. ' Subsection (5) is addedto section 837.25, Florida Statutes, to
read:, '
337.25 Acquisition, lease and disposal of real and personal property ,
(5) In addition to the options otherwise available to the department, prop-
erty held by the department .which is no longer used or needed may be con.
vered without consideration to a coUnty, municipality, or other uult of local
government to.be used for a publlc purpoSe. 'In the case of property acquIred
for use as, a borrow pit which is no 'longer needed, the department may Bell
such property to the owner of the parcel of abutting land from which the bor-
row pit was originally acquired, provided the sale shall be at a ,negotiated
price not less than fair market value' as determined by' an independent ap-
praisal, the cost ofwbIch is paid by the oW'I!er of such abuttinglancL
Section 2. This act shall take effect July 1, 1977. _.
