The City Attorney has authorized the cancellation of the lot mowing
charges totaling $42 against the subject property as other valuable
consideration by the City in the acquisition of certain right of way from
the subject owners.
Attached is blind copy of a letter to Whatley Construction Company.

THL3 AGREEMENT, made and entered into this / ~ay of February,
196.6, between WHATLEY CONSTRUCTION CO. OF FLORIDA, INC.
hereinafter referred to as "Owner'!
and the CITY OF CLEARWAT:SR, COUNTY OF PINELLA3, STATE OF FLORIDA. here-
inafter referred to as "Purchaser";
WITNESSETH:
WHEREAS, the City of Clearwater requires property hereinafter described as
right of way for construction and rnaintenance of an authorized city, county or state
street or highway and said Purchaser is required to furnish same for such purpose;
NOW, THEREFORE, in consideration of the premises and other good and
valuable considerations, it is agreed as follows:
(a) The Owner agrees to sell and convey, by good and sufficient warranty deed,
free of liens and encumbrances, except as herein otherwise indicated, unto the City
of Clearwater, a municipal corporation, the following desc.ribed land in Pinellas
County. Florida, to wit:
South 10 feet of Lot 1, Block A of Norwood Subdivision,
according to the Map or Plat thereof as recorded in Plat
Book 5, page 79 of the Public Records of Pinellas County,
Florida
net to the Owner; and in further consideration the Purchaser

$42.00 presently assessed against the parent tract hereinbefore described.

(c) All current taxes for the year shall be paid by the Owner. ~

1. That Whatley Construction Go. of Florida, Inc. is the owner of the
following described property in Pinellas Couhty, Florida, to wit:
South 10 feet of Lot I, Block A of Norwood Subdivision,
according to the Map or Plat thereof as recorded in Plat
Book 5, page 79 of the Public Records of Pinellas County,
Florida.
a.. That said property is now in possession of the record owner
3. That there has been no labor performed or materials furnished on
said property within the past ninety (90) days for which there are unpaid bills
for labor or materials against said property.
4. That there are no liens or encumbrances of any nature affecting the
title to the property hereinbefore described.
5. That it is hereby warranted that no notice has been received of
any public hearing regarding assessments for improvements by any govern-
ment within the past ninety (90) days, and it is hereby warranted that there are
no unpaid assessments against the above property for improvements thereto
by any government, whether or not said assessments appear of record.

inducing the City of Clearwater to purchase the above descril?ed property.
