Stewart City Manager City of Clearwater, Florida PO Box 1348 Clearwater, Florida Dear Mr. Stewart: On April 17, 1963, we entered into an agreement to sell to the City of Clearwater the following described real estate: Lots 16 and 17, Block H; Lots 8 and 9, Block 1; Lots 4, 5, 6, 7 and 8, Block J; all in Fairmont Subdivision, according to map or plat thereof recorded in Plat Book 9, page 85 of the Public Records of Pinellas County, Florida. As of this date the real estate transaction is being closed and we are giving possession to the City of Lots 8 and 9, Block I, Fairmont Subdivision. We understand that the City is holding $1,000.00 of the purchase price until delivery of possession of all of the lots. Very truly yours, ~;:Cf ~dtU.A.<A'.A Ruth Be le~ -~UCker ~--..' --.L. 1 I I REAL ESTATE CONTRACT THIS AGREEMENT, made this /7.d day of April, 1963, between RUTH BELLE TUCKER, a widow, and GEORGE TUCKER, a single man, hereinafter referred to as "Sellers 11, and CITY OF CLEAR- WATER, a Florida Municipal Corporation, hereinafter referred to as the IIPurchaserll; WITNESSETH: That in consideration of the mutual promises and covenants herein contained, and other valuable considerations passing between the parties hereto, the Sellers agree to sell and the Purchaser agrees to buy the following described property situate, lying and being in Pinellas County, Florida: Lots 16 and 17, Block H; Lots 8 and 9, Block I; Lots 4, 5, 6, 7 and 8, Block J; all in Fairmont Subdivision, as recorded in Plat Book 9, page 85 of the Public Records of Pinellas County, Florida. The total purchase price of said property shall be the sum of $23,000.00 payable at the times and in the manner following: Purchaser shall pay the sum of $2,300.00 in cash as earnest money deposit immediately upon the full execution of this document by both the Sellers and the Purchaser. The balance of $20, 700. 00 to be paid in the manner following: $19, 700. 00 shall be paid on closing and the balance of $1,000.00 shall be paid upon final delivery of possession of all lots. Possession to Lots 8 and 9, Block I, Fairmont Subdivision, shall be given the City on or before April 23, 1963, which shall be the date of closing. The Sellers hereby agree to remove the dwelling located on said Lots 8 and 9, Block I, Fairmont Subdivision, prior to the closing date aforesaid at no cost to the City. Sellers further agree to remove any and all cars, junk, parts and other appurtenances that they wish to remove from the two said lots prior to closing date aforesaid. -1- (j)' L. I I -! The Sellers and the Purchaser mutually agree that the Sellers shall have 120 days from the date of these presents to deliver possession of the remaining 7 lots. Sellers shall have the right to remove during the said 120 days each and every house, building, fence and any other thing of value now belonging to them from the said lots prior to delivery of possession of the said 7 lots. Anything remaining at the end of the 120 day period shall become the property of the City of Cleai"water to dispose of as it sees fit without the Sellers exercising any ownership whatever. All removal and other work to be done by responsible individu3.ls and in a workmanlike manner. At the end of the 120 day period aforesaid and possession of the balance of the lots being given to the City, the City will then deliver the balance of the purchase price, to wit: $1,000.00. IN CONSIDERATION WHEREOF the Sellers agree and promise to convey to the purchaser by good and sufficient warranty deed containing full covenants of warranty a fee simple, marketable title to the real estate above described, free and clear of all encumbrances whatsoever, except as herein otherwise provided. The Sellers agree to deliver to the Purchaser, as soon as the same can be obtained with reasonable diligence, a commitment for title insurance in the amount of the purchase price, which commitment shall show a marketable, unencumbered, fee simple title to said property in the Seller except as herein otherwise provided. The Purchaser shall have a reasonable time after the delivery of said commitment for the examination thereof, and within said period shall notify the Sellers in writing of any objections to said title. If this notification is not given within a reasonable time, then said title shall be conclusively deemed to be acceptable to the Purchaser. In the event that the title of the Sellers is not good and marketable, the Sellers shall have a reasonable time thereafter to perfect the title; and if the defects are not cured within such time, then the purchaser may demand a return of all earnest moneys paid by him and cancel this contract, or waive the defects and accept the property without deduction on account of said defects. -2- . .. The Sellers shall place the necessary Documentary Tax Stamps upon the Warranty Deed given in pursuance of this agreement; and it shall be a specific condition of this agreement that the Sellers will notify any and all tenants, presently occupying the aforesaid premises, to vacate and leave said premises in good condition within the period of 120 days from date hereof. This sale shall be closed not later than April 23, 1963. Time of pay- ment and time of delivery of the respective parcels to the City as aforesaid shall be of the essence hereof, and upon default in payment of any part of the purchase money as and when the same becomes due, the Sellers may rescind this contract, retaining the cash consideration paid therefor as liquidated damages, and thereupon this contract shall be null and void. Possession of the vacated premises and real property covered by this contract shall be delivered to the Purchaser upon closing and as aforesaid. The obligations and benefits under this contract shall extend to the personal representatives, heirs and assigns of the respective parties hereto.
