THIS INDENTURE, Made this 18th day of December
A. D., 1970, between SEABOARD COAST LINE RAILROAD COMPANY, a corporation
under the laws of the Commonwealth of Virginia, party of the first part;
CITY OF CLEARWATER, a municipal corporation under the laws of the State of
Florida, party of the second part; and UNITED STATES TRUST COMPANY OF NEW
YORK, Corporate Trustee under the First (formerly General) Mortgage dated
March 1, 1950, made by the former Atlantic Coast Line Railroad Company, to
which Seaboard Coast Line Railroad Company is successor by merger, party of
the third part;

WITNESSETH: That said party of the first part, for and in con-
sideration of the conveyance to it as hereinafter recited and set forth, has
granted, bargained and sold, and by these presents does grant, bargain, sell
and convey unto said party of the second part, its successors and assigns,
forever, all that certain tract or parcel of land at Clearwater, Pinellas
County, Florida, more particularly described as follows, to wit:
For point of reference, commence at the northeast
corner of Section 16, Township 29 South, Range 15 East,
and run thence South 880 58' 40" West, along the north
line of said Section, 734.50 feet to a point on the
westerly boundary line of Seaboard Coast Line Railroad
Company's main track right of way; thence South 30 06'
40" West, along said westerly boundary line, 632.80 feet
to a point on the westerly extension of the south line
of Laura Street, the Point of Beginning.
From the point of beginning thus described, continue
South 30 06' 40" West, 263.16 feet to the north line of
Cleveland Street, as established by City Ordinance; thence
North 880 21' 56" East, along said north line of Cleveland
Street, 60.21 feet; thence North 30 06' 40" East, 262.68
feet to a point on the westerly extension of said south
line of Laura Street; thence South 880 49' 10" West,
60.17 feet to the point of beginning; containing 0.36 of
an acre, more or les-s, and being shown outlined in YELLOW
on print of Drawing No. G-3-46, prepared by L. Butler,
Registered Engineer #1468, Registered Surveyor #78, which
print is attached hereto and made a part hereof.
Together with all and singular the tenements, hereditaments and
appurtenances thereunto belonging or in anywise appertaining, and the rever-
sions, remainder and remainders, rents, issues and profits thereof and also
all the estate, right, title, interest, property, possession, claim and
demand whatsoever of said party of the first part, both in law and in equity,
of, in and to the above granted premises.
TO HAVE AND TO HOLD the same in fee simple forever; SUBJECT, How-
ever, to all conditions, covenants, restrictions, reservations and easements
affecting said premises.

Except as to the matters referred to in the preceding paragraph,
said party of the first part does covenant with said party of the second
part that it is lawfully seized of said premises, that they are hereby con-
veyed free from all encumbrances and that it has good right and lawful
authority to sell the same, and said party of the first part does hereby
fully warrant the title to said land, and will defend the same against the
lawful claims of all persons whomsoever.
The property hereinabove conveyed is subject to the lien of the
First (formerly General) Mortgage bf the former Atlantic Coast Line Railroad
Company, dated March 1, 1950, as supplemented and modified, under which mort-
gage United states Trust Company of New York is Corporate Trustee, and said
Trustee, party of the third part, joins herein for the purpose of releasing
and does hereby release the land hereby conveyed from the lien of said mort-
gage pursuant to the provisions of Section 6.01 of Article Six thereof.

The recitals of fact made hereinabove are to be taken only as
recitals made by Seaboard Coast Line Railroad Company and not by said Trustee.
THIS INDENTURE FURTHER WITNESSETH: That said party of the second
part, for and in consideration of the conveyance to it as hereinabove recited
and set forth, has granted, bargained and sold, and by these presents does
grant, bargain, sell and convey unto said party of the first part, its suc-
cessors and assigns, forever, all that certain tract or parcel of land at
Clearwater, Pinellas County, Florida, more particularly described as follows,
to wit:
A 50-foot right of way lying 25 feet either side
of the following described center line:
From the southeast corner of Section 9, Township
29 South, Range 15 East, run North 890 24' 16" West, a
distance of 220.00 feet; thence run North 00 10' 14"
East, a distance of 25.00 feet to the southeast corner
of Lot 5, Block 8, "E. H. Coachman Subdivision", as
recorded in Plat Book 6, page 56, of the public records
of Pinellas County, Florida; thence run North 890 24'
16" West, a distance of 91.00 feet; thence run North 40
05' 16" West, a distance of 338.15 feet to a Point of
Beginning.
From the point of beginning thus described, run
North 10 55' 16" West, a distance of 90.00 feet to a
point of curvature; thence along a curve to the left
having a radius of 521.67 feet, a chord, bearing North
150 28' 16" West, of 244.45 feet; thence North 290 01'
16" West, a distance of 116.85 feet to a point of curva-
ture; thence along a curve to the right having a radius
of 521.67 feet, a chord, bearing North 100 00' 16" West,
of 339.37 feet to a point of ~erminus; thence North 90
00' 44" East, a distance of 173.55 feet; thence South 850
41' 44" West, a distance of 369.05 feet to the northwest
corner of Lot 19, Block 2, Hart's Addition, as recorded
in Plat Book 1, page 94, of the public records of

formerly a part), Florida; LESS AND EXCEPT the exist-
ing Seaboard Coast Line Railroad Company and Tampa &
Gulf Coast Railroad Company rights of way; containing
0.50 of an acre, more or less, and being shown outlined
in RED on print of Drawing No. J-1l8, dated December 23,
1969, revised July 27, 1970, prepared by Hilborn Werner
& Assoc., Inc., which print is attached hereto and made
a part hereof.
