AS SECURITY UNDER MORTGAGE made and entered into this
of November, A. D. 1974, by and between the CITY OF CLEARWATER, FLORIDA,
a municipal corporation, hereinafter referred to as "City", and JOSEPH K.
TURNER and LAURA W. TURNER, his wife, as tenants in common, hereinafter
referred to as "Turner'!;
WITNESSETH:
WHEREAS, on March 24, 1971, the City executed a Mortgage Deed,
as Mortgagor to Turner, as Mortgagees, covering the following described
real property situate, lying and being in the County of Pinellas and State of
Florida, to wit:
Lots 1, 2 and 3 of Block 7, A. C. Turner's Subdivision
No.3, according to the map or plat thereof as recorded
in Plat Book 1, page 32 of the Public Records of
Hillsborough County, Florida, of which Pinellas County
was formerly a part,
which Mortgage Deed was recorded on March 25, 1971, in Official Record
Book 3509, page 705, of the Public Records of Pinellas County, Florida; and
WHEREAS, on March 24, 1971, the City also executed a promissory
note payable to Turner in the amount of $59,625.00, payable in ten annual

N 88042'56" W along a North line of the Plat of Imperial
Park Unit 5 (see Plat Book 63, page 6, Public Records of
Pinellas County, Florida) 704.65 feet; run thence N 0056'161' E,
406.57 feet; ,run thence S 89003'44" E along a 40 acre line being
the centerline of Lakeview Avenue, 698.96 feet to the P. O. B.;
LESS AND EXCEPT the Northerly 50 feet thereof for the
right-of-way of Lakeview Avenue as conveyed to the City of
Clearwater in O. R. Book 2766, page 489, Public Records
of Pinellas County, Florida; and subject to a drainage
easement over the Easterly 50 feet thereof and over the
Southerly 150 feet thereof;
and
WHEREAS, Turner is agreeable to this request;
NOW, THEREFORE, in consideration of the foregoing premises
and other good and valuable considerations between the parties hereto, receipt
of which is hereby acknowledged, the parties hereto covenant and agree
as follows:
1. Turner hereby releases from the Mortgage Deed recorded in O. R.
Book 3509, page 705, of the Public Records of Pinellas County, Florida, the
following described real property, situate, lying and being in Pinellas County,
Florida:
Lots 1, 2 and 3 of Block 7, A. C. Turner's Subdivision
No.3, according to the map or plat thereof as recorded
in Plat Book 1, page 32, of the Public Records of
Hillsborough County, Florida, of which Pinellas County
was formerly a part,
which said property shall be free and clear of the lien of said mortgage.
2. The City of Clearwater, Florida, does hereby substitute as security
under the said Mortgage Deed recorded in O. R. Book 3509, page 705, of the
Public Records of Pinellas County, Florida, the following described real
property, owned by the Mortgagor, City of Clearwater, situate, lying and
being in Pinellas County, Florida:

3. The parties hereto hereby ratify and affirm all other terms and
provisions of the original note and mortgage that are not inconsistent with
this agreement, specifically including the right on behalf of the City to prepay
all or any part of the principal of said note without penalty and with interest
to date of payment only.
4. This agreement shall be binding on the heirs, personal representatives,
executors, successors and assigns of the parties hereto.
