D. 1976, by and betweenC1TY OF CLEARWATER, FLORlDA, a municipal corporation, hereinafter referred to as Seller, and PETER RODICH, hereinafter referred to as Purchaser; WITNESSETH: That in consideration of the payments and covenants herein provided, and other good and valuable considerations, Seller agrees to sell and Purchaser agrees to buy the real estate situate in Pinellas County, Florida~ described in Exhibit A attached hereto and made a part hereof, subject to final description being furnished by an independent survey of said real property. The total purchase price for said property shall be the sum of Eighty Thousand Dollars ($80,000,00), payable as follows: $1,000, 00 cash to be paid upon execution of this Agreement, receipt of which is hereby acknowledged and the balance of $79,000,00 paid upon closing of this transaction which shall be on or before ninety (90) days from the date hereof. IN CONSIDERATION WHEREOF; the Seller agrees to convey said property to the Purchaser by good and sufficient Deed, with a fee simple, marketable title, free and clear of all encumbrances. Taxes for 1975 and prior years shall be paid by Seller, and taxes for 1976 shall be prorated as of date of closing, Seller shall affix the required documentary stamps and Purchaser shall record the Deed. Seller shall at its expense furnish title insurance, certified to the date of this Agreement or later, evidencing a good record unencumbered title and deliver same to Purchaser on or before thirty (30) days from the date hereof. Purchaser shall have fifteen ( 15) days after delivery of such title insurance commitment for examination and acceptance thereof and/ or to notify Seller, in writing, of any objections to said titleo If no notification is received by Seller within said time, then said title shall be conclusively deemed to be acceptable to Purchaser.
