Attached hereto is Warranty Deed covering the above purchase
which is now to be recorded. In accordance with the Agreement
of Sale, the City is to pay for the documentary stamps to be affixed
to said deed. The documentary stamps are $46.20 Federal and
$84.00 State making a total of $130.20.
Also attached is Tax Receipt No. 22155 and letter from Alex D.
Finch acknowledging receipt of the purchase price and confirming
that the house will be vacated and possession given to the City on
or before the 20th day of September, 1961, which instruments are
for your files.

REAL ESTATE CONTRACT
THIS AGREEMENT made and entered into this)f~~day

joined by her husband, THOMAS H. SHEPHERD, and LOUISE B. PITTMAN,
joined by her husband, H. MARVIN PITTMAN, as Sellers, and
The CITY OF CLEARWATER, a municipal corporation, as Purchaser.
WITNESSETH: That in consideration of the mutual
promises and covenants herein contained, and other valuable
considerations passing between the parties hereto, the Sellers
agree to sell and the Purchaser agrees to buy the following
described property, situate, lying and being in Pinellas County,
Florida:
Lot Five (5) of MARKLEY'S ADDITION
TO CLEARWATER, Florida, according
to the map or plat thereof as re-
corded in Plat Book 1, page 97, of
the Public Records of Pinellas
County, Florida,
upon the following terms and conditions:
1. The total purchase price of said property shall
be the sum of Forty-two Thousand ($42,000.00) Dollars payable
at the times and in the manner following:
(a) Four Thousand Two Hundred ($4,200.00)
Dollars paid this date by Purchaser to Sellers as earnest money
deposit, receipt whereof is hereby acknowledged.
(b) Thirty-seven Thousand Eight Hundred
($37,800.00) Dollars to be paid by Purchaser to Sellers in cash
at the time and date of closing.

2. The property shall be conveyed by Warranty
Deed and shall be free and clear of all encumbrances whatsoever.
3. That Sellers shall furnish to Purchaser Abstract
No. 20,465 compiled by Guaranty Title and Trust Company of
Clearwater, through the 8th day of December, 1924, and an
ownership and encumbrance report from said date to the present
time, which shall show good and merchantable title to the above
described property and shall deliver same to Purchaser on or
before August 24, 1961, and it is agreed that this transaction
shall be closed and the Purchaser shall pay the balance of the
purchase price as above stated and execute all papers necessary
for the completion of this purchase on or before September 1,
1961. However, should the title prove defective, then the
Sellers shall have ninety (90) days time after due notice of
such defect or defects, to remedy the title in a manner satis-
factory to Purchaser or its attorney, or sufficient for the
Purchaser to obtain a title insurance policy at Purchasers
expense. After which time, if such defect or defects are not
corrected by the Sellers so that there is a merchantable title,
then the Purchaser may at its option withdraw said deposit
which is being retained by ALEX D. FINCH, of the firm of FINCH
AND MOSLEY, as escrow agent for Sellers, and thereafter be
relieved from all obiigations hereunder. If the abstract and
the title check show good and merchantable title in the Sellers
as provided herein, and the Purchaser shall not have objected
to or demonstrated otherwise within the period of time allowed
for closing of this transaction, said title shall be deemed
to be acceptable to the Purchaser and should Purchaser fail~
neglect or refuse to make the balance of the payments hereinabove

stated, or to pay the balance of the purchase price as above
set forth, the earnest money deposit in the amount of
Four Thousand Two Hundred ($4,200.00) Dollars shall be retained
by or delivered to Sellers as liquidated damages by reason
of the Purchaser's failure to complete this transaction. It
is further understood and agreed that this is an out and out
purchase and not an option to purchase given to the City of
Clearwater, the Purchaser in this contract.
4. That possession of the above described premises
shall be given to Purchaser on or before thirty (30) days from
date of this contract.
5. All real property taxes for the year 1961 shall
be paid by Purchaser. It being understood, however, that
Sellers shall pay all taxes through the year 1960, and furnish
to Purchaser a tax statement from the Clerk of the Circuit Court
which reflects that all real property taxes have been paid and
that there are no outstanding or unpaid taxes or tax certificates.
6. The required documentary stamps, both state and
federal, shall be placed on the deed by Purchaser and at
Purchaserts expense.
7. It is understood and agreed by and between the
parties hereto that the Sellers shall have the right to remove
from said premises all personal effects and all furniture,
fixtures and equipment. It is also understood that the Sellers
shall have the right to remove from said premises any and all
shrubs located on and upon said premises.
8. The loss or damage to the premises by fire or
other casualty, after the delivery of the deed, is assumed
by Purchaser.
9. Time is the essence of this agreement and all
covenants and agreements herein contained shall extend to and

be obligatory upon the heirs, executors, administrators and
assigns of the respective parties. The words "Sellers" and
"Purchaser" herein employed shall be construed to include the
plural as well as the singular.
