of dower, reversion, remainder and easement thereto belonging or in anywise
appertaining.

the said party of the first part does covenant with the said party of the second
part that she is lawfully seized of the said premises, that they are free of all
incumbrance, and that she has good right and lawful authority to sell the same;

nellas, State of Florida, hereinafter referred to as IIpurchaser"j
WHEREAS, parties hereto did, on February 9, 1962, enter
into a purchase and sale agreement for certain premises located at
318 Sunset Court, Clearwater, Florida, and
WHEREAS, that purchase and sale agreement is today being
consummated,
NOW THEREFORE, in consideration and confirmation thereof,
it is mutually understood and agreed that Purchaser hereby grants
unto Owner three (3) year right of occupancy, and Owner agrees to
care for premises in accordance with provisions of paragraphs num-
bered "2" and "4" of said agreement.
IT IS FURTHER MUTUALLY UNDERSTOOD AND AGREED between the
parties hereto that the premises which are to be occupied and
cared for by Owner are those upon which is located the dwelling
house and garage from the easterly line of the real property des-
cl'ibed to the edge of the area commonly referred to as the IIbluff".
All other part thereof Purchaser will, have full possession of and
be obligated to care for and maintain.
The term of occupancy by OWner may be earlier terminated
by Owner if she so desires and Purchaser will thereupon accept
possession of and responsibility therefor.

PROVIDED ALWAYS, That if said Mortgagor shall pay to the said
Mortgagee a certain promissory note, a copy of which is attached hereto, and
shall perform and comply with each and every stipulation, agreement and covenant
of said note and of this mortgage, then this mortgage and the estate hereby created
shall be void, otherwise the same shall remain in full force and virtue. And the
said Mortgagor covenants to pay the interest and principal promptly when due,
and to pay the taxes and assessments on said property.
Should any of the above covenants be broken, then said note and
all moneys secured hereby shall without demand, if the Mortgagee so elects,
at once become due and payable and the mortgage be foreclosed, and all costs
and expenses of collection of said moneys by foreclosure or otherwise, including
solicitor's fees, shall be paid by the Mortgagor, and the same are hereby secured.

FOR VALUE RECEIVED, THE CITY OF CLEAR WATER, a
municipal corporation, promises to pay to the order of SALINE
HOFFPAUIR, at such place or places as the payee may from time to
time designate, the principal sum of NINETY -FIVE THOUSAND DOLLARS
($95,000. OO) with interest thereon at four (4%) per cent per annum from
date on the whole amount of said principal sum remaining unpaid from
time to time, payable as follows:
$10,000.00 on the 10th day of March, 1963;
$10,000.00 on the 10th day of March, 1964; and
$10,000.00 on the 10th day of March of each and every year
thereafter until the entire principal sum has been
paid in full.
In addition to the principal payments as above outlined, interest
shall be paid annually beginning March 10 , 1963, until the entire
principal and interest has been paid in full.
All or any part of the principal of this obligation may be prepaid
without penalty and with interest to date of payment only on any regular
interest payment date.
This note is secured by a mortgage of even date, and the same
is incorporated by reference herein.
If any of the said sums of money herein referred to be not
promptly and fully paid within thirty (30) days next after the same
severally become due and payable, the entire unpaid balance then due on
this note shall become due and payable forthwith or thereafter at the
option of the payee, her heirs or assigns, as fully and completely as if

WHEREAS I the City of Clearwater requires property, hereinafter described,
as right of way for construction and maintenance of an authorized city" county
or state street or highway and for park and other municipal purposes;
NOW I THEREFORE I in consideration of the premises and other good and
valuable consideration I it is agreed as follows:
1. The Owner agrees to sell and convey by good and sufficient
Warranty Deed I free of all liens and encumbrances unto the City of
Clearwater, a municipal corporation, the following described land in Pinellas
County, Florida, to wit:

At and for the sum of One Hundred Five Thousand Dollars ($IOS,OOO.OO) and/or
other services on behalf of the purchaser as follows:
Purchaser agrees to pay Two Thousand Dollars ($2,000.00) down as earnest
money deposit upon it or its agent signing this Agreement and an additional Eight
Thousand Dollars ($8 1000.00) cash on the closing of this transaction, which said
closing shall be on or before thirty (30) days after full execution of these premises.
Purchaser agrees to pay an additional Ten Thousand Dollars ($ 10 I 000.00) per year I
plus interest at four per cent ( 4% ) per annum until all principal and interest shall
have been paid, payments to be applied first to interest and then to principal.
Purchaser agrees to give back a purchase money mortgage and note securing the
unpaid balance of this obligation upon closing.
2. Purchaser, as a part of the consideration for the sale of these premises I
agrees to allow the Owner to occupy the premises, rent free, for a period of three
( 3 ) years after the closing of this transaction. Owner agrees not to sublet the
premises or any portion of them fqr any purpQ~El~ The Owner agrees to pay all
utilities consumed as a result of her occupancy of the premises.
3. The Owner agrees that the Purchaser shall have the undisturbed right to
fill any and all of the submerged lands during her tenancy and agrees not to impede
in any manner the Purchaser's development of the property for park, municipal and
roadway purposes.
4. The Owner agrees to maintain the premises during her occupancy as
aforesaid in an orderly, neat and attractive manner and agrees to allow no waste
or deterioration of the premises, ordinary wear and tear by the elements excepted I
and agrees to turn over the premises to the Purchaser in as good condition as they
were on the date of closing I ordinary wear ancldecay by the elements, excepted.

5. Both parties to this Agreement agree that current taxes shall be pro-rated
as of date Of closing and the Owner agrees to place the necessary documentary
stamps upon the Deed and to pay the intangible tax on the mortgage. Purchaser
agrees to place the documentary stamps on the note and each agree to pay its own
recording costs.
6. Owner agrees to furnish title insurance showing good and merchantable
title as of the date of execution of these presents, or abstract of title re-certified
to the date aforesaid. Owner shall have ninety (90) days within which to correct
any defects of title. Failure to correct the same will cause this Agreement to be
voidable at the instance of the Purchaser with all earnest money to be returned
should the Purchaser elect to void the Agreement.
7. Owner agrees to hold the Purchaser harmless and does hereby indemnify
the Purchaser against any and all claims for a real estate commission with regard
to the sale of this property. The Owner agrees to pay, compromise, settle and/or
defend any law Sl.li,t wherein a real estate co~ission is claimed with regard to the
sale of this property.
