was formerly a part
Dear Mr. Haines:
We call your attention to the enclosed Survey Certificate
prepared by Rompon and Associates dated September 21, 1961 showing
the 15 foot alley as captioned, which runs North and South between
Chestnut Street and Rodgers Street, and hereby inform you that we
take the position that the City owns this alley. This conclusion
is based on these facts:'
(1) Action by the City Commission on February 3, 1947 at which
time this alley was reopened by motion as set forth in the
attached certified copy of excerpt of Minutes of City
Commission Meeting of that date;
(2) That, in 1947 and 1960 the City, exercising the right of owner-
ship, entered upon and utilized this alley in order to install
~ and subsequently maintain a 6" and 8" sanitary sewer line; and,
(3) That for approximately 20 years the Peninsular Telephone Company
and its successor, the General Telephone Company have utilized
said alley to carry their buried telephone cable, cable pole
and drops attached to said pole.
The alley was originally vacated by action of the City Commission
on November 15, 1922, such action having been based on a specific
condition to be performed as set forth in the attached certified copy
of the Minutes of the City Commission Meeting of that date. Your
attention is directed to the fact that the specific condition is shown
in the excerpt to have been that '~. Driscoll (owner) will erect a
modern apartment house on his property there if this alley is closed."

" There is no evidence of record that such a modern apartment house
(or other structural improvement) has ever been erected on the West
half of Lot 3 of Block 1 of Wallace's Addition to Clearwater; and, we
submit that the field records of the Tax Assessor's office for the
years ensuing since 1922 will undoubtedly support this contention.
In light of the foregoing evidence, therefore, we hereby
request that the permanent records of the Tax: Assessor be corrected
I to indicate that said alley is City-Owned; and therefore, is not
properly assessable to the title to the West one-~alf of Lot 3 of
Block 1 of Wallace's Addition to Clearwater, which currently is in
the name of Robert E. Strawser, Guardian of the Estate of Mary Edna
Strawser, Incompetent.
The City has acquired title from Mr. Strawser to the North
30 feet of this alley by Quit Claim Deed as recorded in the Public
Records of Pinellas County, OR 1396, Page 579, as per Survey.
The remaining South 120.44 feet of the alley which is 15 feet in
width containing 1,806.6 square feet more or less is, therefore,
the land area which we hereby request be shown as owned by the City
of Clearwater.
We would appreciate your acknowledgment and cooperation in
effecting this correction.
