AGREEMENT
THIS AGREEMENT, made and entered into this 28th day
of
April
, 1967, between MILDRED D. SAWYER, and
PHILIP SAWYER, her husband, hereinafter referred to as 110wner", and
the CITY OF CLEARWATER, FLORIDA. a municipal corporation, herein-
after referred to as "Purchaser ";
WITNESSETH
WHEREAS, the City of Clearwater requires property hereinafter
described for right of way for Pierce Street in the City of Clearwater,
Florida;
NOW, THEREFORE, in consideration of the premises and other good
and valuable considerations, it is agreed as follows:
1. The Owner agrees to sell and convey by good and sufficient
warranty deed, free of liens and encumbrances, except as herein otherwise
indicated, unto the City of Clearwater, Florida, a municipal corporation,
the following described land in Pinellas County, Florida, to wit:
of a Corrected Plat of Subdivision of W. 260.4 ft. of Lot 2,
That part of Lot 21,/R. H. Padgetts Subdivision ~XfC
of SE-l/4 of NW -1/4 of Section 15, Township 29 South,
Range 15 East, as recorded in Plat Book 4, page 41 of
the Public Records of Pinellas County, Florida, described
as follows: Begin at the NW corner of said Lot 21 for a
P. O. B.; run thence S 8901114711 E along the North line of
said Lot for a distance of 130.2 feet to the NE corner of
said Lot 21; thence S 0001146" along E side of said Lot for
a distance of 30. 23 feet; thence along a curve to the left,
whose chord is S 84019125" W, 131. 74 feet; whose arc is
132.01 feet and whose radius is 599.02 feet, to the SW
corner of said Lot 21; thence N 0001146" E for a distance
of 50. 16 feet to the P. O. B .
at and for the sum of Two Thousand Dollars ($2, 000. 00).
2. Purchaser agrees to pay the Owner an additional Eight Hundred
and Fifty Dollars ($850.00) to be used by the Owner for moving the house
and appurtenances thereto noW situate on the property described above to
a location on Lot 22 of R. H. Padgetts Subdivision No.2, of SE-l/4 of
NW -1/4 of Section 15, Township 29 South, Range 15 East, as recorded in
Plat Book 4, page 41, Public Records of Pinellas County, Florida, under
the following conditions:

a. The Owner hereby requests the said~ check for house moving
be made payable both to the Owner and James F. Holley, Jr., Building
Moving Contractor.
b. House shall be set on concrete piers, facing Pierce Street,
and there shall be a 25 foot setback from each street, according to contract
between Owner and Mover.
c. Fron.t porch will be filled under the slab, according to contract
between Owner and Mover.
d. Stub will be roughed in 5 feet from house and garage for
toilets in accordance with contract between Owner and Mover and City
forces will connect up with City sewer from the 5 foot stub aforesaid.
e. Old garage building on the premises shall be razed and material
salvaged for the Owner which work is to be done by City forces or agents.
f. House shall be connected to the sanitary sewer as provided in
Paragraph d above, together with the water, gas and electrical systems,
but all interior plumbing, gas lines and electrical systems shall be
provided by the Owner.
g. It is specifically understood and agreed that the contract for the
moving of said structure is exclusively between the Owners, Mildred D.
Sawyer and Philip Sawyer, her husband, and James F. Holley, Jr., Building
Moving Contractor, and the City of Clearwater is not a party to said contract
and does not in any manner obligate itself to see that said moving and related
work is properly performed by the said James F. Holley, Jr. and is in no
way obligated for the mover's faulty work or negligence should any occur.
3. Purchaser further agrees-that when:pav1.ngand curos- are installed
in Pierce Street as an assessment project, that the real property owned by
Owner shall not be assessed.
4. Closing shall be on or before thirty (30) days from the date
hereof or as extended from time to time by mutual agreement.

5. All taxes for 1966 taxable year to be paid by the OWner.
The Purchaser will place the necessary documentary stamps upon the
Warranty Deed.
6. This contract shall be binding on the heirs, succes sors and
assigns of the parties hereto,

presents to be executed in their respective names, in duplicate, on the
date first above written.
