WHEREAS, the City desires to extend Pierce street east from Prospect Avenue to Greenwood Avenue, and the First Party is the owner of the lots in Block "B" of Coachman Heights SubdiviSion, and the Second Party is the owner of the lots in Block "A" thereof, through which said Pierce Street extension will be surveyed and constructed; and WHEREAS, the City has caused said Pierce Street extension to be designed and surveyed. and determined and caused to be prepared L,,"',\ a plat thereof, showing the route and measurements thereof, which ," has been agreed to and accepted by all the parties hereto __ the <~~ original of which plat is in the City Engineerts office and a copy '\ thereof has been delivered to the First and Second Parties and another copy is hereto attached and by reference made a part hereof; and said Pierce Street extension is to have a width of sixty feet (60t) from Prospect Avenue to its intersection with Greenwood Avenue; and 'YvH:EnEA~:r,'t1ie ~Flrst-'arid"Becotid'-part:teshave -agreed to deed eo the City of Clear. water the right-of-way for such extension and the City, in exchange therefor, has agreed, among other things, that it will, within fifteen (15) months from June 21, 1951, pave, curb, and gutter (in which latter term is not included storm sewers) said Pierce Street extension from Prospect Avenue to Greenwood Avenue, Re-recorded to show corrected desoription and plat. ' t . . - DEm1437 .'525 said pavement to be thirty feet (30') in width and to be of the same quality, depth and kind ~s Prospect Avenue will be paved from Park to Court Streets; and if the City deems it advisable, it will also construct sidewalks; and that the cost of all such pavir~, curbing, sidewalking and guttering shall be borne by. the City and, in addition thereto, the City has agreed that, within two (2) years from June 21, 1951, it will make a diligent and sincere effort to open Pierce Street across the rights-of-way of the Seaboard Air Line Railway and the Atlantic Coast Line Railway so as to connect Pierce Street as it now exists east and west of said rights of way, -_ all of which will more fully appear from a Resolution passed by the City Commission if said City on June 27, 1951. NOW, THEREFORE, in order to carry out said agreement on the part of the First and Second Parties and in consideration of the exchanges to be made, the undertakings of the City of Clearwater, Florida, and the benefits to be received, the First and Second Parties do hereby grant. and convey unto the City those certain parcels of real estate as described on EXHIBIT "A" hereto-attached and as also identified on the map or plat of such extension of Pierce Str~et from Prospect Avenue to Greenwood Avenue, identified as EXHIBIT "B" hereto-attached, and both by reference made a part hereof; TO HAVE A1TI TO HOLD unto the City of Clearwater, its successors and assigns, said right-of-way as above-described and for street- purposes' use. The City, by the acceptance of this conveyance does hereby agree that it will carry out all the provisions of said Resolution of June 27, 1951 above-referrEd-to, wherein it accepted the offer of the First Party. and Second Party.
