Together with all land, submerged land and riparian rights, which lie

in Clearwater Bay
The grantee herein assume's and agrees to pay that certain mortgage
executed by the grantor herein in favor ofR. Lane Coachman., as
Executor and Trustee under the Last Will and Testament of Mae
S. Coachman, deceased, upon which there is presently due the sum

3. DESCRIPTION OF PROPERTY:
The South 83.3 feet of the ~orth 233.3 feet
of that part of Section 16, Township 29 South,
Range 15 East lying West of Osceola Avenue
4. ABSTRACT OF TITLE:
No. 11093 prepared by the Pinellas County Title
Company of Clearwater, consisting of one hundred
twenty-one pages.
5. RECORD OWNERS:
Basing my oplnlon on the above described abstract,
I have examined the title to the above property from
August 4, 1915.to June 24, 1954, and find that the
title to said property appears to be vested in the
Clearwater School of I,lusic and Allied Arts, Inc., a
non-profit Florida corporation, whose evidence of
title is an Executor's Deed from H. Lane Coachman, as
Executor and Trustee of the Estate of ~~e S. Coachman,
dated December 14, 1950, and recorded in Deed Record
1299, Page 157 of the public records of Pinellas
County, Florida.
This opinion is subject to the following objections
and exceptions:
A. RESTRICTIONS:
(1) Deed or Plat Restrictions. There are no deed or
plat restrictions of record.
(2) Governmental Restrictions. Any building on the
subject property must comply with the appropriate
zoning restrictions of any municipality in which
the property presently lies. Any present structure
would not be subject to those restrictions, but any
future building should conform therewith.
B. LIEI~S OR ENCUW3RANCES:
Two mortgages presently exist on the captioned property
as follows: A mort~age in favor of T'lay V.G. Williman
and H. Lane Coachman, as Executor and Trustee of the
Estate of Mae S. Coachman, in the principal amount of
$26,508.26, which mortgage was recorded in the public
records of Pinellas County, Florida, on December 14,
1950, in mortgage record 813, page 337, and that certain
mortgage in favor of. r::ay V.G. Williman, a wid01'l, in the
principal amount of ;,~4,000.00, which mortgage was re-
corded in the public records of Pinellas County, Florida,
on December 1, 1953, in mortgage record 983, page 621.
Any unpaid bills for labor performed or materials
furnished on said premises are the bases for liens for
a period of ninety days after so performed or furnished.

C. BOUNDARY LINES:
Exception is taken to all questions of survey and
boundary lines, and to any state of facts which would
be revealed by an inspection of said property.
D. POSSESSION:
Exception is taken to the rights of any persons in
possession if other than the above narned owners.
E. TAXES:
This property is exempt from State, County and City
taxes.
CONCLUSION
Based upon my examination of said abstract of title, I
am of the opinion that a good and merchantable title to said
property is vested in Clearwater School of Music 3.nd Allied
Arts, Inc., a Non-profit Florida corpora~ion, subject only to
matters not appearing on the face of the aforementioned
abstract, and subject to the matters hereinbefore set out.

Conservatory of Music, Inc., formerly Clearwater School of
Music and Allied Arts, Inc., a non-profit Florida corporation,
who being first duly sworn depose and say:
1. That the Clearwater Conservatory of Busic, Inc.,
a non-profit Florida corporation, is the OVoiDer of the following
described property in Pinellas County, Florida:
The South 83.3 feet of the North 233.3 feet
of that part of Section 16, Township 29 South,
Range 15 East lying West of Osceola Avenue
2. That said property is now in possession of the record
ovlner.
3. That there has been no labor performed or materials
furnished on said property within the past ninety days for which
there are unpaid bills for labor or materials against said

affecting the title to the property hereinbefore described except

ttRESOLVED that the Board of Directors of CLEARWATER CONSERVATORY
OF MUSIC, mc., hereby affirms the action taken by the meeting of
the Board of Directors authorizing the proper officers of the cor-
poration to enter into a contract for the sale of the property ow.ned
by the corporation at 114 North Osceola Avenue, Clearwater, Florida,
to the City of Clearwater for the sales price of $41,500.00, less
expenses of sale, including real estate commission, and further
ratifies and affirms the execution of the contract by the vice-
president of this corporation.
"FURTHER RESOLVED that the vice-president and secretary of CLEARWATER
CONSERVATORY OF MUSIC, INC. be and they are hereby authorized and
directed to execute a proper deed of conveyance of said property to
the City of Clearwater, Florida, a municipal corporation, in accor-
dance with the terms of the contract of sale previously mentioned and
dated June 15, 1954.

shall be applied as follows:

by you of the property now owned by the Clearwater Conservatory
of Music located at 114 N. Osceola Avenue and more fully shown
on the attached plat.

It is contemplated that witil such time as the City ac-
quires possession of the property the Conservatory will have the
privilege of using the building until such tillle as the City should
need it for their own use, it being understood that the Conservatory
shall pay all expenses relating to t he upkeep of the property, such
as Fire Insurance premiums ~~d any expenses required to keep the
building and its equipment in good condition.
Proposition B-
If the City desires to purchase the ..properti- at once,
the Conservatory will acc~,t a cash price of ~43,000.09. There
is a mortgage with a Rresently outstanding balance of $18,508.26
bearing interest at 6% per annbllll which the City can assume. Poss-
ession can be given within 90 days from the date of notice by the
City to that effect.
The Bacon property which adjoins the Conservatory on
the south can be purchased by the City at a cash price of ~16,OOO.
Should the City desire to acquire the property on a time basis,
the owner is willing to sellon the following payments:

That the indebtedness secured by the mortgage dated
December 14, 1950, executed by CLEARWATER SCHOOL O:B' MUSIC AND
ALLIED ARTS, INC., a non-profit Florida corporation, and MAY
v.G. WILLIMAN to H. LANE COACHMAN, as Executor and Trustee
under the Last Will and Testament and of the ESTATE OF MAE S.
COACH1~N, Deceased, recorded December 14, 1950 in Mortgage
Book 813 on page 337 of the public records of Pinellas County,
Florida; and said mortgage having been assigned by H. Lane
Coachman, as Testamentary Trustee of the Mae S. Coachman Trust
to H. Lane Coachman, by Assignment of Mortgage dated December 16,
1958 and recorded December 31, 1958 in Official Record Book 496,
page 218 of said public records of Einellas Cobnty, Florida,
encumbering property in Pinellas County, Florida, as described
in the mortgage and assignment thereof, to-wit:
FIRST PROPERTY - Coachman Residence:
That part of the South eighty-three and three tenths
(83.3) feet of the North Two Hundred and Thirty-three
and three tenths (233.3) feet of Section Sixteen(16),
Township Twenty-nine (29) South, Range l!'ifteen (15)
East, which lies West of the right of way of the
public thoroughfare in the City of Clearwater, Flor-
ida, known as "Osceola Avenue" according to the lo-
cation of this right of way on the date of
October 11th, 1950;
Together with all land, submerged land and riparian
rights, which lie between Westerly projections of
the ~orth and South boundaries of said tract, ex-
tended to intersection with the channel, or navigable
water, in Clearwater Bay.
And the venetian blinds, the hot-water heater and central
