Dear Sir:
In accordance with your request the undersigned has examined
Abstract No. 1253, prepared by Pinellas County Title Company and last
certified to date of April 15, 1964, containing 11 pages.
Subject to persons in adverse possession, reservations and
restrictions of record, any statement of facts which a competent survey
would reveal and the zoning laws of the City of Clearwater, it appears
that the marketable title is vested in W. M. POWELL and CLARA
POWELL, his wife.
A Warranty Deed, properly executed by W. M. Powell and
Clara Powell, his wife, to the City of Clearwater would pass title subject
to the foregoing exceptions and obj ections.

EASEMENT
FOR AND IN CONSIDERA TION of the sum of One Dollar ($1. 00) cash in hand
paid to them, the receipt of which is hereby acknowledged, and the benefits to be
derived therefrom, W. M. POWELL, also known as William J. Powell, and CLARA
POWELL, his wife, do hereby grant and convey to the CITY OF CLEARWATER,
FLORIDA, a temporary easement over, under and across the following described
land, lying and being situate in the City of Clearwater, County of Pinellas, State
of Florida, to wit:
TE MPORAR Y EASEMENT
The North 50 feet of Lot 23, ENGHURST ADDITION TO
CLEAR WATER, as recorded in Plat Book 1, page 23
of the Public Records of Pinellas County, Florida.
This easement is granted for the purpose of allowing the City of Clearwater
to enter upon the said property to remove from its present site the frame cottage
located at 1304 North Myrtle Avenue; and it is mutually understood and agreed
that the City of Clearwater and/ or its agents will have the right of access for
delivery of personnel, equipment and materials over the said property; and it
is further under stood and agreed that in the event any damage should result
from the use of the property for the purpose hereinbefore set forth that the City
of Clearwater will make full and complete restoration of such damage; and this
provision shall apply specifically to one citrus tree located in close proximity
to the West wall of the said frame cottage.
IN WITNESS WHEREOF, the parties hereto have set their hands and seals
this 26 day of May, 1964.
