JAMMINZ OF CLEARWATER BEACH INC (2) ~, J I IN RE: REVOCATION OF CONDITIONAL USE APPROVAL for ]AMMINZ' OF CLEARWATER BEACH, INC. Case No. CU 96-29 / ORDER OF THE CITY COMMISSION THIS CAUSE came on to be heard on February 6, 1997, on the City of Clearwater's Notice of Revocation of Conditional Use Approval! Alcoholic Beverage Transfer of Ownership. After providing due notice to the approval holder pursuant to Code of Ordinances Section 6.27, and after hearing and considering the evidence, the City Commission makes the following findings: Findings of Fact 1. Jamminz' of Clearwater Beach, Inc. failed to comply with and violated Condition (e) of the City Commission's conditional use approval, in that it did not obtain all necessary owner's approvals to transfer the occupational and state alcoholic beverage licenses within sixty days of October 3, 1996. 2. J amminz' of Clearwater Beach, Inc. failed to comply with and violated Condition (g) of the City Commission's conditional use approval, in that it did not, within ninety days of October 3, 1996, implement and thereafter continuously maintain the operation of the facility as a restaurant and dance club in a manner in keeping with the style of operation described in the testimony of Cheryl Presti at the September 30, 1996 appeal hearing. 3. The above-referenced failure to comply with the Conditions (e) and (g) additionally constitutes a violation of Code of Ordinances Section 41.034. I"r, , " , ' ,/'--~> ( - . ~ I l i j Conclusion Based upon the above Findings of Fact, the City Commission hereby REVOKES the conditional use approval for the sale of alcoholic beverages on change of business ownership previously granted by its Order of October 3, 1996.
