Florida.
KNOW ALL MEN BY THESE PRESENTS that the undersigned, being
the owners in fee simple of all of Lots 45, 46 and 13 of BAYSIDE
SUBDIVISION NO.2, according to the map or plat thereof as re-
corded in Plat Book 27, Page 32 of the Public Records of
Pinellas County Florida 'do hereby declare that all of Lot 13
of BAYSIDE SUBDivISION N6. 2 is subject to the following restrictions:
These restrictions and limitations are to be regarded as
covenants running with the land regardless of whether or not they
are specifically mentioned in any deeds or conveyances subsequently
executed.
1. All of the said Lot 13 shall be used and utilized as a
drain field for the disposal of the septic tank effluent resulting
from the construction of a motel on the aforesaid Lots 45 and 46,
and for no other purpose except as herein provided.
4 2. No building or structures requiring footings shall be
constructed aboveground thereon the said Lot 130
3. Maintenance, repair, and replacement of any and all
pipes and sewers serving said drain field located on the aforesaid
Lot 13 will be borne by the owners of said Lot 13, and the opening
or tunneling under any public street or sidewalk for the repair,
maintenance or replacement of said pipes and sewers may be done
only upon permission and wlth the authority of the City Manager
of the City of Clearwater.

4. These covenants and restrictions are to run with the land,
and shall be binding on all the parties and all persons claiming
under them until such time that an adequate City sewer serves this
area and specifically Lots 45 and 46, or until such time as the
said Lot 13 is no longer used as a drain field, and when after
such time permission is granted by the City Engineer of the City
of Clearwater.
5. If any person or persons, firm or corporation or their
heirs, assigns, or successors shall violate or attempt to violate
any of these restrictions, it shall be lawful for any other person
or persons, including the City of Clearwater who shall be aggrieved
or injured as a result of such violation, or attempted violation,to
prosecute any proceeding at law or in equity against the person or
persons violating or attempting to violate any such covenant or
restrictions, and either to prevent him or them from so doing or to
recover damages or other dues f~ such violation.
6. Invalidation of anyone of these covenants by judgment or
court order shall Tn no Wise affect any of the other provisions
which shall remain in full force and effect.
