AGREEMENT FOR PURCHASE
AND SALE OF REAL ESTATE

THIS AGREEMENT made and entered into this 2J day of

his wife, hereinafter referred to as Seller, and the CI TY OF CLEARWATER,
FLORIDA, a municipal corporation, hereinafter referred to as Purchaser.
WITNESSETH: In consideration of the payments and covenants herein
provided, and other good and valuable considerations, Seller agrees to sell
in trade and Purchaser agrees to buy in trade the herein described real
estate in accordance with the terms and conditions listed below:
1 (a) The Seller agrees to exchange with the Purchaser a strip of
property on Papaya Street described as follows:
{Description No. I}
A strip of land 10 feet in width that lies adjacent to and at
right angles and south of the south line of the Plat of
Clearwater Beach Park, as recorded in Plat Book 10, page 42,
Public Records of Pinellas County, Florida, said strip being
bounded on the West by the West Right of Way line of Gulfview
Boulevard extended south and on the east by the West line of
Barbour-Morrow Subdivision as recorded in Plat Book 23,
page 45, Public Records of Pinellas County, Florida,
this said property to be exchanged for property on Marianne Street, owned
by the Purchaser and described as follows:

All that portion of Right of Way described in Deed Book 837,
page 597 of the Public Records of Pinellas County, Florida,
that lies West of a right angle line to said south Right of Way
line being 206 feet (two hundred and six feet) West of the West
line of Barbour-Morrow Subdivision as recorded in Plat Book
23, page 45, Public Records of Pinellas County, Florida,
the said exchange to be by Warranty Deed from the Seller, free and clear

of all encumbrances, and Fee Simple Deed from the Purchaser.
1 (b) Seller, as a part of this consideration, agrees to give the
Purchaser a properly executed Quitclaim Deed to the following described
property:

Being more particularly described as a strip of land 25.3 feet
in width lying parallel to and adjoining the west line of the plat
of Barbour-Morrow Subdivision as recorded in Plat Book 23,

page 45, Public Records of Pinellas County, Florida, said
strip of land being bounded on the South by the North Right of
Way line of Marianne Street and on the North by the South
Right of Way line of Palm Street according to aforesaid
Barbour -Morrow Subdivision Plat. Aforesaid Palm Street
is now named Papaya Street;
which said property is a portion of the right of way of Mandalay Avenue.
I (c) Seller agrees to convey property on Mandalay Avenue, more
particularly described as follows:
(Description No.4)
Being more particularly described as a strip of land 40 feet
in width as measured at right angles to and lying west of and
adjoining the West line of the Plat of Barbour-Morrow Sub-
division as recorded in Plat Book 23, page 45, Public Records
of Pinellas County, Florida, less the East 25.3 feet, said
strip of land being bounded on the South by the North right of
way line of Mariarme Street and on the North by the South Right
of Way line of Palm Street according to aforesaid Barbour-
Morrow Subdivision Plat. Aforesaid Palm Street is now named
Papaya Street;
in consideration of the sum of $30,000.00 net to the Purchaser, inclusive
of all closing costs, said property to be conveyed by Seller to the Purchaser
by Warranty Deed free and clear of all encumbrances.
1 (d) Seller agrees to clear all property conveyed by Seller to
the Purchaser within 80 days. This shall include the removal of any and
all trailers, cabanas, dwellings and appurtenances of any sort, and it is
hereby agreed that anythin.g of value left on the conveyed premises shall
become the property of the Purchaser, and the Purchaser shall not
be liable in any marmer for the removal of any such property above described
or otherwise that would interfere with its right to construct a road or
sidewalk thereon.
2 (a) The Purchaser agrees to execute a Fee Simple Deed to the
property on Marianne Street described as Description No. 3 in 1 (a) above
for the property on Papaya Street described as Description No. 1 in
paragraph I (a) above.
2 (b) The Purchaser agrees to accept properly executed Quitclaim
Deed from the Seller for the property described in 1 (b) above known as
Description No.2.

2 (c) Purchaser agrees to purchase the property described in
1 (c) above, known as Description No.4, to get additional right of way
on the West side of Mandalay Avenue, for the sum of $30,000.00 net to
the Seller, payable in cash on closing.
2 (d) Purchaser agrees to relocate the Sea Shell sign, at its own
expense, on adjacent property owned by the Seller.
2 (e) The Purchaser agrees to widen Mandalay Avenue in front of
the Seller1s property and build a sidewalk thereon, all of which shall be
at no cost to the Seller, and no assessment shall be levied against any
properties abutting this improvement owned by the Seller.
3. In the event that the Purchaser purchases title insurance on
the above described right of way purchase, and alter an examination of
the said title there appears to be a cloud on said title, and alter due
notification to the Seller by the Purchaser, the Seller shall have a reasonable
time within which to correct any such defect in title, and if such defects
are not cured within such reasonable time then the Purchaser may demand
the return of any and all earnest monies paid by it and cancel this contract,
or waive the defects and accept the property without deduction on account
of such defects. If Purchaser shall default under this contract, the earnest
money deposited shall be retained by Seller in lieu of liquidated damages,
and in the event the Seller defaults under this contract, the Purchaser
may enforce its rights by appeal to the courts for specific performance
or any other legal remedy available to it.
4. Taxes for 1964 and prior years on the properties described
as Description No. 1 and Description No.4 shall be paid by the Seller,
and the taxes for 1965 on the said properties, if any, shall be assumed
by the Purchaser.
5. This transaction shall be closed on or before January 29, 1965.
Time of payment shall be of the essence hereof.

A STOCK COMPANY
a corporation of Missouri, herein called the Company, for a valuable consideration, hereby insures
the party named in Schedule A, hereinafter called the Insured, the heirs, devisees, personal repre-
sentatives of such Insured, or, if a corporation, its successors by dissolution, merger or consolida_
tion, against loss or damage not exceeding the amount stated in Schedule A, together with costs, at-
torney's fees and expenses which the Company may become obligated to pay as provided in the
Conditions and Stipulations hereof, which the Insured shall sustain by reason of:
1. Any defect in or lien or encumbrance on the title to the estate or interest covered hereby in
the land described or referred to in Schedule A, existing at the date hereof, not shown or
referred to in Schedule B or excluded from coverage in Schedule B or in the Conditions and
Stipulations; or
2. Lack of a right of access to and from the land;
all subject, however, to the provisions of Schedules A and B and to the Conditions and Stipulations
hereto annexed; all as of the date of this policy.

signed and sealed as of the date of policy shown in Schedule A, the policy to become valid when
