RE-PLAT; according to the map or plat thereof as recorded
in Plat Book 21, page 21 of the public records of pinellas
County, Florida.
2. That said property is now in possessi~n of the record owner (s).
3. That there has been no labor performed or materials furnished on
said property within the past three months for which there are unpaid
bills for labor or material against said property; and that there are
no claims whatsoover of any kind or description against said premises
for which liens could be filed according to the statutes in such cases
made and provided.
4. That they hereby warrant that they have received no notice of any
public hearing regarding assessments for improvements by any G~vernment
within the past three months, and that there are no unpaid assessments
or liens against the above property for improvements thereto by any
Government, whether or not said assessments appear of record.
5. That there is no outstanding unrecorded contract of sale, deed,

That WHEREAS~ Johnnle Johns/and JucLnlta Johns,
his wife, and the City of Clearwater, Florida, did enter into a certain
Exchange Agreement on or about March 23, 1966, to exchange Lot 11,
Block A, according to a replat of Block A and Lots 1 to 15 inclusive, Block
B, Clearwater Beach Park First Addition, for Lot 27 and the North 15 feet
of Lot 26, Block B, Clearwater Beach Park First Addition; and
WHEREAS, it has appeared that Condition No. 3 of the said Exchange
Agreement cannot be accomplished;
NOW ~ THEREFORE~ it is mutually agreed between the parties
hereto as follows:
1. Condition No. 3 of the terms and conditions of said Exchange
Agreement is hereby declared null and void and the following shall be the
new Condition No.3, to wit:
This Exchange Agreement is subject to second party vacating
the following, to wit:
The portion of a 15 foot alley lying East of Lots 27,
28 and 29, and the North 15 feet of Lot 26 of Clearwater
Beach Park, First Addition, Plat Book 15, Page 80
of the Public Records of Pinellas County, Florida.
Simultaneously with the vacation of said alley, parties of the first
part agree to execute and deliver to the said City an Easement
for the purpose of constructing and maintaining therein all types
of utilities including water, sewer, telephone and electric lines
which said Easement shall inure not only to the benefit of the City
of Clearwater, but to General Telephone Company and Florida
Power Corporation as well.
2. The original offer in this Addendum shall be deemed revoked
unles s accepted in writing by all parties on or before May 10, 1966.
3. The closing of this transaction is hereby extended to June
15, 1966.
