RESTRICTIONS
WHEREAS, Lester Bernfeld and Shirley Bernfeld, his wife, Irving
Kabiller and Elaine Kabiller, his wife, Ben Kook and Ann Kook, his wife,
Phyllis Levinson, divorced and not remarried, and Rosalyn Zavatsky, divorced
and not remarried, are the owners of the following real property situate, lying
and being in the County of Pinellas and State of Florida, to wit:
The South 600 feet of the E 1/4 of the NE 1/4 of the NE 1/4
lying South of State Road 590 and West of U. S. Highway 19,
further described as follows: From the NE corner of Section
7, Township 29 South, Range 16 East, run S 0054'44" W along
the centerline of U. S. Highway 19, 89.58 feet; thence N 89005'
16" W, 100.00 feet to a point on the West right-of-way line of
U.S. Highway 19; thence S 0054'44" W along said West right-of-
way line, 641. 00 feet for a P. O. B. ; thence continue S 0054'44" W,
along said West right-of-way line 599.78 feet; thence N 89056'04" W,
235.69 feet; thence N 0053'39" E, 603.26 feet; thence S 89005'16" E,
235.85 feet to a point on said West right-of-way line and the P. O. B.;
and
WHEREAS, said Owners desire to place certain restrictions upon said
property, which shall be covenants running with the land, for the protection of
themselves, persons and corporations purchasing said property from them or
their heirs, executors or assigns, and the City of Clearwater, Florida, a
municipal corporation;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that in
consideration of the foregoing premises and other good and valuable consideration
between the parties, receipt of which is hereby ackmowledged, the undersigned,
Lester Bernfeld and Shirley Bernfeld, his wife, Irving Kabiller and Elaine Kabiller,
his wife, Ben Kook and Ann Kook, his wife, Phyllis Levinson, divorced and not
remarried, and Rosalyn Zavatsky, divorced and not remarried, as owners of the
above described real property, do hereby adopt and promulgate the restrictive
covenants hereinafter set forth:
1. These restrictions and limitations are to be regarded as covenants
running with the land regardless of whether they are specifically mentioned in
any deeds or conveyances subsequently executed.
2. Any apartment project to be located on the above des cribed tract shall be
limited to a maximum. density of 24 dwelling units per acre. However, should a
motel project be constructed thereon rather than an apartment project, then the
density allowed shall be in accordance with the zoning regulations for "CTF"
(Commercial-Tourist Facilities Use District) as set out in the Code of Ordinances
of the City of Clearwater, Florida.
3. These covenants and restrictions shall be binding on all parties and
all per sons claiming under them, and no exception, variation, or termination
