WITNESSETH:
WHEREAS, Section 7-2 of Article I, Chapter 7, Buildings, of the
Code .of Ordinances of the City of Clearwater, Florida, 1962, as alnended,
requires, pursuant to the Southern Standard Building Code, 1976 edition as
adopted, that prior to the Issuance of a building permit to erect a structure
within or encroaching an easement held by the City of Clearwater, Florida, th,
applicant must execute a Release in which such person acknowledges that such
structure will be removed any time the City of Clearwater determine s that
work within the easement area requires its removal; and
WHEREAS,
DALE, DEL BELLO
has applied for a
building permit to erect a structure subject to Ordinance 1821; and
WHEREAS,
DALE DEL BELLO
, as applicant
for a building permit to erect a structure ln an easement area, pursuant to the
requirements of this section set out by the Ordinance hereby agrees that he
or his successors will be bound by the provisions of the above referenced Code
section, and hereby releases the City of Clearwater, Florida, from any and
all damages or compensations which may arise by reason of removal of the
structure erected pursuant to this Ordinance; and
WHEREA S,

for said permit agrees to be bound by the Code regulations, and the structure,
pursuant to this Release, may be removed at any time the City needs to work
in the easement area and its removal is deemed necessary; and
WHEREAS, all of said real property is within the corporate limits of.

to place certain restrictions on said property, which shall be covenants running

NOW, THEREFORE, the parties covenant and agree as follows:

and specifically agrees that the City of Clearwater may remove the structure
being erected pursuant to Building Permit No.

at any time the City needs to work in the easement area and removal is
deemed nece s sary.
2. Applicant hereby rele?-ses the City of Clearwater from any and all
damage claims or claims for compensation that may arise by reason of
removal of the structure.
