WHEREAS, Early J. McMullen, Sr. and Mary B. McMullen, his wife,
and E. Stuart McMullen and Frances ~ McMullen, his wife, are the owners
of the following real property situate, lying and being in the County of Pinellas
and State of Florida, to wit:

Government Lot 2 in Section 16, Township 29 South,
Range 16 East; LESS the North 800 feet thereof; and
LESS the South 100 fe et of the West 483 feet of the
North 900 feet thereof; and LESS the South 205 feet
of the East 930 feet thereof; and LESS the triangle East
of Bayshore Boulevard; and LESS the East 360 feet of the
South 140 feet of the North 1090 feet thereof; and LESS
the South 221 feet, LESS the East 930 feet of said South
221 feet;
WHEREAS, said Owners desire to place certain restrictions upon
said property, which shall be covenants running with the land, for the pro-
tection of themselves, persons and corporations purchasing said property
from them or their heirs, executors, successors, or assigns, and the City
of Clearwater, Florida, a municipal corporation;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that
in consideration of the foregoing premises and other good and valuable con-
sideration between the parties, receipt of which is hereby acknowledged,
the undersigned, Early J. McMullen, Sr. and Mary B. McMullen, his wife,
and E. Stuart McMullen and Frances U McMullen, his wife, as owners of
the above described real property, do hereby adopt and promulgate the restrictive
covenants hereinafter set forth:
1. These restrictions and limitations are to be regarded as covenants

running with the land regardless of whether they are specifically mentioned
in any deeds or conveyances subsequently executed.
2. The apartment project to be erected On said real property shall
contain no more than 217 dwelling units.
3. These covenants and restrictions shall be binding on all parties
