ing under the laws of the State of Florida, hereinafter referred to as
WITNESSETH: That in consideration of the mutual the Purchaser.

considerations passing between the parties hereto, the Seller
agrees to sell and the Purchaser agrees to buy the following

2. The property shall be conveyed by
warranty
deed
and shall be free and clear of all encumbrances whatsoever,

public roads.
3. Seller agrees at his expense to order a commitment of
title insurance from a reputable title insurance company doing
business in Pinellas County, Florida, within five days after.the
execution of this contract and thereafter to pay for an owners'
ti.tle policy in the face amount of the purchase price if the same
is issued. In the event said commitment for title insurance in-
dicates that the title to said property is merchantable and free
and clear of liens and encumbrances except as herein otherwise
provided, this transaction shall be thereupon completed as herein
provided. In the event commitment shall indicate otherwise, the
Seller shall have a period of sixty days after notification thereof
within which to cure defects in title and thi.s sale shall be
closed within ten days after notice of such curing to the Purchaser
fir his attorney.
Upon Sellers failure to correct said defects
within the time limit; the earnest money deposit shall be returned
to the Purchaser upon demand and all rights and liabilities
arising hereunder 13hall terminate.. In the event Seller shall per-
form all of his obligations under this contract and Purchaser
shall fail or refuse to make the balance of the payments, or to
pay the balance of the purchase price as above set forth, the said
cash payment made on this date may be retained by or delivered to
the Seller as liquidated damages by reason of the Purchasers
failure to complete this agreement.

4. Possession will be given upon closing and subject to the
other provisions of this agreement, this transaction shall be con-
c1uded not later than November 15, 1959.
5. All parties hereto understand that Gertrude A. Na1l is
the owner of an undivided one-half interest in and to the above des-
cribed tract, and that the remaining undivided one-half is the prop-
erty of Myrtie A. Smith, Deceased, whose estate is now in the process
of probate and administration in the County Judge's Office, Pine11as
County, Florida. The parties hereto further understand that this
contract is made upon the specific condition that the sale is subject
to the approval of said Court in so far as the undivided one-half
interest of Myrtie A. Smith is concerned.
6. Time is essence of this agreement and all covenants and
agreements herein contained shall extend to and be obligatory upon
the heirs, executors, administrators, successors and assigns of
the respective parties. The words nSel1er" and "Purchaser" herein
employed shall be construed to include the plural as well as the
singular. This contract consists of three pages, the first two
pages being set out in mimeographed form and the last page type-
written.
