RESTRIC TIONS
WHEREAS, Ruth 1. Byerly is the owner of the following real property
situate, lying and being in the County of Pinellas and State of Florida, to wit:
Lots 19, 20 and 21 in Block "B" of Sunset Point Estates,
according to the map or plat thereof as recorded in Plat
Book 39, page 67 of the Public Records of Pinellas County,
Florida; LESS AND EXCEPT the following described portion
of said Lot 19: Begin on the Southerly extension of the East
boundary of Lot 27, Block B of described Sunset Point
Estates at a point 538.07 feet South 00 11158" West of the
NE <::orner of said Lot 27, run thence South 37052'27"
West 25. 11 feet, thence North 89039129" East 15 feet;
thence North 00 11'58" East 20 feet to the point of beginning;
and
WHEREAS, said Owner desires to place certain restrictions upon
said property, which shall be covenants running with the land, for the pro-
tection of herself, persons and corporations purchasing said property
from her or her heirs, executors or assigns, and the City of Clearwater,
Florida, a municipal corporation;
NOW t, THEREFORE, KNOW A LL MEN BY THESE PRESENTS, that in
consideration of the foregoing premises and other good and valuable con-
sideration between the parties, receipt of which is hereby acknowledged, the
undersigned, Ruth I. Byerly, as owner of the above described real property,
does hereby adopt and promulgate the restrictive covenants hereinafter set
forth:
1. These restrictions and limitations are to be regarded as covenants
running with the land regardless of whether they are specifically mentioned
in any deeds or conveyances subsequently executed.
2. The operation of a gas oline filling station is hereby prohibited
upon the above described real property.
3. These covenants and restrictions shall be binding on all parties
and all persons claiming under them, and nO exception, variation or termination
of these restrictions shall be authorized or effective without the prior written
consent of the City of Clearwater.
