WARRANTY DEED
THIS INDENTURE, made the 27th day of November A. D. 1963
by BLANCHE L. BERGMAN" a widow, hereinafter called the grantor, to the CITY
OF CLEAR WATER, FLORIDA, a municipal corporation, whose postoffice address
is Box 1348, Clearwater, Florida, hereinafter called the grantee:
WITNESSETH: That the grantor, for and in consideration of the sum of
$10.00 and other valuable considerations, receipt whereof is hereby acknowledged,
hereby grants, bargains, sells, aliens, remises, releases, conveys and confirms
unto the grantee, all that certain land situate in Pinellas County, Florida, viz:
That part of Fractional Section Sixteen {16}, Township Twenty-nine
(29) South, Range Fifteen (IS) East, in the City of Clearwater,
Pinellas County, Florida, described as follows:
BeginniJ1g at a point 100 feet West of the Southwest corner where Drew
Street and Fort Harrison Avenue intersect in the City of Clearwater,
Pinellas County, Florida, run thence South 70 feet; thence West 144.2
feet; thence North 70 feet; thence East 144.2 feet to the point of be-
ginning, said property being situated in Clearwater, Pinellas County,
Florida.
Also described as: That part of Fractional Section Sixteen {16}, Town-
ship Twenty-nine (29) South, Range Fifteen (IS) East in the City of
Clearwater, Florida, beginning at a point which is reached by measur-
ing as follows:
From the NE corner of said Section 16, Westwardly along its North
boundary 1320.8 feet to a point corresponding to the NW corner of the
NE-1/4 of the NE-1/4 of said Section, if it were normal size; thence
continuing West along said boundary, 15 feet, to its intersection with
a projection of the West line of Ft. Harrison Avenue across Drew Street;
thence South along this projection, 20 feet, to the SW corner of the
intersection of Drew Street and Ft. Harrison Avenue; and thence West
along the South line of Drew Street, parallel to said North Section
boundary 100 feet, to the point of beginning for said above mentioned
plot of land.
From the point of beginning, thus established, run then::e South 70
feet, parallel to Ft. Harrison Avenue; thence West parallel to the
North boundary of said Section 16, 144.2 feet, more or less, to a
point 100 feet East along the same parallel line, from the East boundary
of Osceola Avenue, as this boundary existed on March 22, 1927; thence
North parallel to Osceola Avenue 70 feet, to the South boundary of
Drew Street; and thence East along said South boundary 144.2 feet,
more or less, to the point of beginning.
TOGETHER with all the tenements, hereditaments and appurtenances thereto
belonging or in anywise appertaining.
TO HAVE AND TO HOLD, the same in fee simple forever.
AND the grantor hereby covenants with said grantee that the grantor is
lawfully seized of said land in fee simple; that the grantor has good right and
lawful authority to sell and convey said land; that the grantor hereby fully warrants

whether or not said assessments appear of record.
6, That the representations embraced herein are for the purpose of inducing
the City of Clearwater, Florida, to purchase the above described property.

REAL ESTATE CONTRACT

between BLANCHE L. BERGMAN ,a widow, herelnafter referred to

as "Seller", and CITY OF CLEAR WATER, a Florida Municipal Corporation,
hereinafter referred to as the "Purchaser";
WITNESSETH
That in consideration of the mutual promises and covenants herein
contained, and other valuable considerations passing between the parties
hereto, the Seller agrees to sell and the Purchaser agrees to buy the
following described property situate, lying and being in Pinellas County,
Florida:
Beginning at a point 100 feet West of the Southwest corner where
Drew Street and Fort Harrison Avenue intersect in the City of
Clearwater, Florida, run thence South 70 feet; thence West
144,2 feet; thence North 70 feet; thence East 144.2 feet to the
point of beginning, said property being situated in Clearwater,
Pinellas County, Florida,
Also described as: That part of Fractional Section 16, Township
29 South, Range 15 East in the City of Clearwater, Florida, be-
ginning at a point which is reached by measuring as follows:
From the NE corner of said Section 16, Westwardly along its
North boundary 1320.8 feet to a point corresponding to the NW
corner of the NE 1/4 of the NE 1/4 of said section, if it were
normal size; thence continuing West along said boundary, 15

The total purchase price of said property shall be the sum of
$40,000.00 payable at the times and in the manner following: Purchaser

shall pay the sum of $20, 000, 00 in cash immediately upon the full execution
of this document by both the Seller and the Purchaser. The balance of
$20,000.00 shall be paid, free of interest, on or before December 31,
1963, at which time this transaction shall be closed.
Possession of the hereinabove described property, together with all
improvements situate thereon, save and except all movable furnishings,
shall be given the City on or before October 15, 1963; and the Seller hereby
agrees to remove from the dwelling located on the said property all movable
furnishings contained therein and to vacate the premises on or before said
date,
IN CONSIDERA TION WHEREOF the Seller agrees and promises to
convey to the Purchaser by good and sufficient warranty deed containing
full covenants of warranty a fee simple, marketable title to the real estate
above described, free and clear of all encumbrances whatsoever, except
as herein otherwise provided.
The Seller agrees to deliver to the Purchaser an abstract of title
showing a marketable, unencumbered, fee simple title to said property
in the Seller except as herein otherwise provided. The Purchaser shall
have a reasonable time after the delivery of said abstract of title for the
examination thereof, and within said period shall notify the Seller in writing
of any objections to said title. If this notification is not given within a
reasonable time, then said title shall be conclusively deemed to be
acceptable to the Purchaser. In the event that the title of the Seller is not
good and marketable, the Seller shall have a reasonable time thereafter
to perfect the title; and if the defects are not cured within such time,
then the Purchaser may demand a return of all earnest moneys paid by
him and cancel this contract, or waive the defects and accept the property
without deduction on account of said defects.
Taxes for the year 1963 and prior years shall be paid by the
Seller.

The Seller shall place the necessary Documentary Tax Stamps upon
the Warranty Deed given in pursuance of this Agreement.
This sale shall be closed not later than December 31, 1963. Time
of payment and time of delivery of the aforesaid property to the City shall
be of the essence hereof, and upon default in payment of any part of the
purchase money as and when the same becomes due, the Seller may rescind
this contract, retaining the cash consideration paid therefor as liquidated
damages, and thereupon this contract shall be null and void.
The obligations and benefits under this contract shall extend to the
personal representatives, heirs and assigns of the respective parties hereto.
