AGREEMENT FOR PURCHASE
AND SALE OF REAL EST A TE

WEIDEMEYER, as Trustee, hereinafter referred to as "Seller", and the
CITY OF CLEARWATER, FLORIDA, a municipal corporation, hereinafter
referred to as "Purchaser";
WITNESSETH: That in consideration of the mutual promises and
covenants herein contained, and other valuable considerations pas sing between
the parties hereto, the Seller agrees t.o sell and the Purchaser agrees to buy
the following described property situate, lying and being in Pinellas County,
Florida, to wit:
Start at the Northeast corner of the NW 1/4 of Section 3,
Township 29 South, Range 15 East, and run South 1188 feet;
thence West 2289. 7 feet to average high water line of Clearwater
Bay for the P. O. B. ; thence run West 650 feet to the East line
of channel; thence run Southwesterly along East line of Channel
344. 6 feet; thence East 650 feet to average high water line;
thence Northeasterly along said average high water line to
F.O.B.
The total purchase price of said property shall be the sum of Fourteeri
Thousand Dollars ($14,000), payable at the times and in the manner following:
$1,000 binder upon the signing of this contract, receipt of
which is hereby acknowledged.
Balance in full at time of closing which shall be on or before
sixty (60) days from the date hereof at the office of the City
Attorney, Clearwater City Hall, 112 S. Osceola Avenue,
Clearwater, Florida.
IN CONSIDERATION WHEREOF, the Seller agrees and promises to_

described, free and clear of all encun1brances, subject to the provisions that
the property shall be dedicated as a deep water public park by the City of
Clearwater and should the same ever be abandoned as such, then the property
would revert back to the Grantor.

Seller shall give to Purchaser within fifteen (15) days a cormnitment
for title insurance in the amount of the purchase price, which corrumtment
shall show a marketable, unencumbered, fee simple title to said property
in the Seller. Purchaser shall have fifteen (15) days after the delivery of
said commitment for the examination thereof, and within sai. d period shall
notify the Seller in writing of any objections to said title. If no notification
is received by Seller within said time, then said title shall be conclusively
deemed to be acceptable to Purchaser. In event Seller's title is not good and
marketable of record, he shall have a reasonable time thereafter to perfect
same, and if such defects are not cured within such reasonable time, then
Purchaser may demand the return of all earnest monies paid by it and
cancel this contract, or waive the defects and accept the property without
deduction on account of said defects. If Purchaser shall default under this
contract, the earnest money deposit shall be retained by Seller in lieu
of liquidated damages andlor as rental for the premises.
Seller shall pay for the documentary stamps affixed to the deed;
the Purchaser shall pay the cost of recording the deed. Taxes for 1975 and
prior years shall be paid by Seller, and taxes for 1976 shall be prorated
as of date of delivery of possession. If the amount of taxes for the current
year cannot be ascertained, rates for the previous year shall be used and
prorated.
Both parties agree that neither have used the services of a real
estate broker in this transaction and no brokerage fee is due anyon'e.
This Agreement shall be binding on the respective personal
represelltatives, heirs, executors, adr:linistrators, successors and assigns
of the -parties hereto.

Southeast Title Insurance Company of Florida
a Florida corporation, herein called the Company, for a valuable consideration, hereby insures the person or
persons named as Insured in Schedule A, together with their heirs, devisees, personal representatives of such
person or persons, or, if a corporation, its successors by dissolution, merger or consolidation against loss o~
damage not exceeding the amount stated in Schedule A, together with costs, attorneys' fees and expenses
which the Company may become obligated to pay as provided in the Conditions and Stipulations hereof,
which the Insured shall sustain by reason of:
any defect in or lien or encumbrance on the title to the estate or interest covered hereby in the land
described or referred to in SCl1~4ule A, existing at the date hereof, not shown or referred to in
Schedule B or excluded from coverage in Schedule B orin the Conditions and Stipulations; or
lack of a right of access to and from the land;
all subject, however, to the Conditions and Stipulations herein contained, which Conditions and
Stipulations, together with Schedules A and B are hereby made a part of this policy.
This policy shall not be valid or binding until countersigned below by a validating officer of the Company.
In Witness Whereof: Southeast Title Insurance Company of Florida has caused
its corporate name and seal to be hereunto affixed by its duly authorized
officers as of the date shown in Schedule A, the effective date of this policy.
