BACKGROU NO: The property 1S located north of Sandy Lane, south of Greenlea
Drive, approximately 840 feet east of N. Highland Avenue. The site is current
ly undeveloped and contains 2.5 acres M.O.L.
There are currently plans to develop 46 condominium units on the site. Follow
1ng initial review of the community impact statement and pTeliminary site plan
for the Sandy Lane Condominium project, the Resource Development Committee
suggested that the access to the project site be through the Pines Condominium
from Greenlea Street to the north of the site. The owners and residents of
the Pines Condominiums rejected such a proposal. The developers of Sandy Lane
Condominiums are propos1ng access to the project from Sandy Lane. In order
for access to be fTom Sandy Lane, an amendment must be made to the Restrictive
Covenants. In addition, the proposed parking for the development would I
require an amendment to the Restrictive Covenants.
The two items requested to be removed from the Restrictive Covenants read as
follows:
5. There shall be no paved parking spaces, areas or driveways
or accessways constructed or erected within the South and
East 33 feet of the subject property.
8. All entranceways to and exits from the subject property for
vehicular traffic shall be from Greenlea Street on the North.
The Resource Development Committee at a special meeting on September 23, 1980
reco~mended that removal of Items 5 and 8 of the Restrictive Covenants be
cons1dered by the.C~ty Commission 1n order that the preliminary site plan for
Sandy Lane Condom1n1ums be considered for approval. TheRDC requested that
p:operty ?\m~rs along Rosemont, Pamelia and Sandy Lane be sent notices of the
C~ty Comm1ss1on consideration of the amendment to the Res~rictive Covenants
Slnce they would be affected by the planned access.
