AMENDMENT TO PERMITTED AREA OF PROPOSED ARMORY
TO BE BUILT ON LOT 10 - CLEARWATER INDUSTRIAL PARK
,
WHEREAS, on August 19, 1959, the City of Clearwater did file
Amendment to Protective Covenants of Clearwater Industrial Park, said
amendment being recorded in o. R. Book 680, Page 63, of the Public
Records of Pinellas County, Florida, all relating to the Plat of
Clearwater Industrial Park as filed in Plat Book 44, Page 46 of the Public
Records of ~aid County and;
WHEREAS, the said City of Clearwater had previously obtained
from all of the recorded owners of the lots in said Plat consent to the
release of all restrictions theretofore imposed on said Lot 10, and;
WHEREAS, it was the purpose of all of the property owners as
well as the City of Clearwater to allow the construction of an Armory
on part of said Lot 10 in accordance with the plans and specifications
then on file with the City of Clearwater, and;
WHEREAS, in addition to the privilege of erecting an Armory
on said Lot 10 it is necessary that the size of the proposed structure
as indicated on the plans and specifications aforesaid be expressly
allowed by waiving the requirements set forth in CLAUSE III - GENERAL
RESTRICTIONS - A. USES, Sub-Section 3, as said protective covenants
of Clearwater Industrial Park contains, same being recorded in o. R.
Book 115, Page 347-354 inclusive of the Public Records of said County.
NOW, THEREFORE, in consideration of the premises the City of
Clearwater does hereby expressly waive the foregoing area requirement
with respect to said proposed Armory in order that it be erected on a
portion of Lot 10, Clearwater Industrial Park as aforesaid;

with the City of Clearwater showing 3,200 sq. ft.
of ground floor building area irrespective of the
provisions set forth in any of the restrictive,
protective covenants or amendments thereto relating
to Clearwater Industrial Park.
2. Provided, however, said Armory may be expanded or
extended from time to time as one contiguous building
site, however, all of the restrictions imposed on
the subdivision shall continue in full force and effect
on the remaining unimproved portion of said Lot 10
from and after completion of said Armory.

3. Nothing herein shall be construed to limit or modify
the other tenns and conditions of the protective
covenants or amendments thereof of aforesaid cover-
ing Clearwater Industrial Park.
