I am awaiting a determination from you. If you determine to proceed with the buyback, then my previous e-mail sets forth the process for the property owner/family to follow. Please see on the attachment #3 regarding the buying back of spaces. As you said back in 2007, we MAY buy it back but it is up to the City Management. I am in agreement with what: Cyndie Goudeau thought then.......... We would rather not be buying and re-selling the cemetery spaces. Preferably, the owners should be responsible for selling their spaces and notifying the City of who to transfer ownership to so we can update our records and ensure the deed is recorded by the County. If the owner has questions about what the selling price should be, he can research what other cemeteries are selling spaces for before placing an ad in a local paper. #1 on the attachment talks about amending the ordinance to say we may buy the space back for current value (instead of original price as the ordinance states now) less fees for recording, etc... This was never done and, in my opinion, would probably dissuade the owner from wanting to sell back to us. In most cases, the owner would probably end up paying more for doc stamps and recording fees than he would make from the sale to the City. It would be much more lucrative for him to advertise and sell to someone for current market value. We'll discuss with Rosemarie and let the owner know of our decision as soon as possible.
