AMENDMENT TO PROTECTIVE COVENANTS
OF THE
CLEARWATER INDUSTRIAL PARK
WHEREAS, the City of Clearwater, Florida, has heretofore recorded

in O. R. Book 115 at page 347, O. R. Book 169 at page 542 and O. R. Book

680 at page 63, certain protective covenants and amendments thereto of
the Clearwater Industrial Park covering the following described property
located in Pinellas County, Florida:
All of Clearwater Industrial Park as filed in Plat
Book 44, page 46, Public Records of Pinellas
County, Florida;
and
WHEREAS, said City desires to convey Lot 12 of the said Clearwater
Industrial Park to the Upper Pinellas Association for Retarded Children
which proposes to build and utilize said construction for use as an
Habilitation Center, but existing covenants prohbiits such use of said
premises; and
WHEREAS, all of the remaining owners of said lots in the said Clear-
water Industrial Park have by written instruments attached hereto and filed
herewith agreed that Lot 12 may be conveyed by the said City so as to enable
the use of Lot 12 as an Habilitation Center and incidental uses thereof; and
WHEREAS, said City wishes to amend said protective covenants to
accomplish the above purposes as hereinafter set out;
NOW, THEREFORE, said City hereby amends the aforesaid protective
covenants as follows:
Section A-I of Clause III, General Restrictions, is further amended
to read as follows:
"The premises shall not, at any time, during the period
of fifty (50) years from July 1, 1956, be used for any other
than manufacturing, industrial or storage purposes,

except Lot 10 of the Clearwater Industrial Park may be used
as a site for an armory and such armory when constructed may
be used for drills, related exercises, class room studies,
storage for arms and other equipment, including certain types
of army vehicles and for other customary uses of an armory,
provided that should Lot 10 cease being used as an armory for
the purposes aforesaid, then and in that event it shall not be
used for any purpose or use other than manufacturing, industrial
or storage, and except Lot 12 of the Clearwater Industrial
Park may be used as a site for the Upper Pinellas Association
for Retarded Children Habilitation Center and such Center when
constructed may be used for the purpose of providing vocational
training directed toward placement of young adults and adults
in industrial occupations, maintaining an industrial contract
shop, a production work shop and related facilities not here-
tofore made available to the retarded, all for the purpose of
making those utilizing said facilities contributing and productive
members of the community, provided that should Lot 12 cease
being used as an Habilitation Center for the purposes afore-
said, then and in that event it shall not be used for any purpose
or use other than manufacturing, industrial or storage.
Nor shall premises or any part thereof, at any time during
said period, be used for the erection or maintenance thereon
of any dwelling, stores, hotels, saloons or boarding houses,
and tha.t there shall not be sold or disposed of at retail upon
said premises or any part thereof, at any time during the
period aforesaid, any spirituous, malt or other intoxicating
liquor of any kind or description. "
All other terms and conditions of said protective covenants as
previously amended, except as herein amended, are ratified and confirmed.
IN WITNESS WHEREOF, the City of Clearwater, Florida, by its duly
constituted authorities, has caused this instrument to be executed, this
