WHEREAS, the owner desires to record a plat of the above described
land subdividing said land into a subdivision to be known as Sunset Woods; and
WHEREAS, said Owner desires to place certain restrictions upon said
property, which shall be covenants running with the land for the protection of
himself, persons and corporations purchasing said property from him or his
heirs, executors or assigns, and the City of Clearwater, Florida, a municipal
corporation;
NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that in
consideration of the foregoing premises and other good and valuable consideration
between the parties, receipt of which is hereby acknowledged, the undersigned,
L. M. LOKEN, as Owner of the above described real property, does hereby
adopt and promulgate the restrictive covenants hereinafter set forth:
1. These restrictions and limitations are to be regarded as covenants
running with the land regardless of whether they are specifically mentioned in
any deeds or conveyances subsequently executed.
2. These restrictions shall be executed and recorded in the Public
Records of Pinellas County, Florida, prior to the recording of the plat for
Sunset Woods, and such restrictions shall govern and apply to the plat of
Sunset Woods approved by the City Commission of the City of Clearwater,
Florida, on February 2, 1978.

3. The right to develop the plat of Sunset Woods shall be subject to
the foUowing:
(a) The owner or developer shall install a wooden stockade type fence
having a maximum height of six feet (6'), with such fence to be located along
the property line or any interior easement in a uniform manner adjacent to
the Montclair Road right-of-way for Lot 1 as shown on the plat of Sunset Woods
and located along the property line or any interior easement in a uniform
manner adjacent to the Sunset Point Road right-of-way for Lots 24, 25, 26
and 27 as shown on the plat of Sunset Woods. Any such fence shall be located in
such manner as to avoid blocking or occupying any easement area identified on
the plat. The owner or developer further agrees to provide three foot (3')
wide gates on each double frontage lot.
(b) The owner or developer may substitute a landscape barrier for
the fence described in sub-paragraph (a) if the composition of the barrier
has received the prior approval of the Planning Department of the City of
Clearwater and the City Forester of the City of Clearwater.
(c) The owner or developer agrees that pursuant to Section 30.02 (3)
of the Code of Ordinances of the City of Clearwater that no vehicle access will
be provided from the street right-of-way to the side or rear of Lot 1 and Lots
24, 25, 26 and 27 as identified on the plat of Sunset Woods.
4. These covenants and re strictions shall be binding on the owner,
his successors and assigns, and all parties deriving any title to the premises
or the right to the use and occupancy thereof by, through or under him, and
the owner hereby covenants and agrees to indemnify, protect and save the
City of Clearwater harmless from all claims by anyone, including reasonable
attorney's fees, in connection therewith.
