by and between the CITY OF CLEARWATER, FLO Florida Municipal
Corporation, party of the first part, and PINELLAS OUN' Y, a political subdivision of
the State of Florida, party of the second part, whose mailing address is 201 Rogers
Street, Clearwater, Florida 33756.
WITNESSETH: That the party of the first part, for and in consideration of
the sum of Ten Dollars ($10,00) and other good and valuable consideration, to it
in hand paid by said party of the second part, at or before the ensealing and
delivery of these presents, the receipt whereof is hereby acknowledged, has
granted, bargained, sold, conveyed and confirmed unto the said party of the
second part, and to its heirs and assigns forever, all the following pieces, parcels,
lots and/or tracts of land, situate, lying and being in the County of Pinellas and State of
Florida, and described as follows, to wit:
Those certain parcels of land having been declared surplus and
dedicated as right-of-way by the Clearwater City Commission,
located and being situate in Sections 1, 11, 12 and 14, Township 29
South, Range 15 East, Pinellas County, Florida, as more particularly
described and depicted in EXHIBITS A, B, C, 0, E, F, G and H
attached hereto and a part hereof
TOGETHER WITH responsibility for and authority over all previously dedicated
and existing right-of-way, whether improved or unimproved, as described and depicted
in EXHIBIT H, and as otherwise depicted in EXHIBIT I, pages 1 through 4, being
identified therein as "EXISTING RIGHT-OF-WAY TO BE CONVEYED TO THE
COUNTY", also attached hereto and made a part hereof.
TOGETHER WITH all and singular the tenements, hereditaments and
appurtenances thereunto belonging or appertaining; and every right, title or
interest, legal or equitable, of the said party of the first part in and to the same,
TO HAVE AND TO HOLD the same unto the said party of the second
part, its heirs and assigns, to its own proper use, benefit and behoof forever,
IN WITNESS WHEREOF, the said party of the first part has caused these
presents to be executed in its name by its City Manager, attested by its City
Clerk, countersigned by its Mayor-Commissioner, and approved as to form by its
Assistant City Attorney, and its corporate seal to be hereunto attached, the day
and year first above written,

DRAINAGE & UTILITIES EASEMENT
FOR AND IN CONSIDERATION of the sum of One Dollar ($1,00) in hand
paid to it, the receipt of which is hereby acknowledged, and the benefits to be
derived therefrom, the
City of Clearwater, Florida, a municipal corporation
P. O. Box 4748, Clearwater, Florida 33758-4748
does hereby grant and convey to Pinellas County, a political subdivision of
the State of Florida, easement over, under and across the following described
lands lying and being situate in the County of Pinellas, State of Florida, to wit:
All of TRACT "A", UNIT 4 OF SKYCREST SUBDIVISION, LESS
AND EXCEPT the West 135 feet thereof, as depicted in
EXHIBIT J, and portions of a tract of land lying within the
Northwest % of Section 12, Township 29 South, Range 15
East, Pinellas County, Florida, being four (4) parcels more
particularly described and depicted in EXHIBITS K, L, M and N,
together being Parcels #25A, #034, #035, #037 and #053 of
KEENE ROAD, PHASE 1 B, attached hereto and made a part
hereof.
The easement rights conveyed hereby are given for drainage and utility
purposes,
Pinellas County shall have the right to enter upon the easement premises and
to construct, install and maintain thereon those drainage and utility facilities
specified in the approved plans for construction of Keene Road, Phase 1 S, and
to inspect and alter such drainage and utility facilities from time to time.
It is expressly understood that Grantor reserves unto itself all rights of ownership
of the easement premises not inconsistent with the easement rights granted
herein.

Easement rights granted herein are binding upon the Grantor, the Grantee, their
respective successors and assigns, The rights are perpetual and irrevocable
except by the written mutual agreement of both parties, or by abandonment of
the easement premises by Grantee,

permit the County, its employees, contractorst inspectors, invitees and equipment
necessary to construct the project in accordance with approved plans.
This Temporary Right of Entry shall commence upon commencement of the project and
terminate upon project completion,
In consideration of the rights herein grantedt the County agrees that not later than
project completion it shall restore all lands encumbered hereby to equal or better
condition as existed prior to commencement of project construction.
