The two deed copies reveal that on March 10, 1942, Mary Elizabeth Ulmer purchased the South one-half (S 1/2) of Lot Ninety Eight (98) in Block Seven (7) which consists of spaces 1 and 2. Both spaces have burials in them. On September 20, 1943, she purchased the North one-half (N 1/2) of Lot Ninety Eight (98) in Block Seven (7) which consists of spaces 3 and 4. Space 3 has a burial in it and space 4 does not. The information on the copy of your birth certificate and the affidavit stating that you are the sole remaining heir of Julius E. and Mary Elizabeth Ulmer will be made a part of the official records in our office. No fees (transfer fee of $25.00 and recording fee of $28.00) are necessary until the actual transfer occurs. In order for the City to affect the transfer, it will be necessary for you to submit the original deed for the North one-half (N 1/2) of Lot Ninety Eight (98) in Block Seven (7), the Cemetery Deed and Consent to Conveyance form completed as indicated and your check for $53.00. The original deed will be voided and two new deeds issued during the transfer; one for space 4 to the purchaser you designate and one for space 3 to you. It is not necessary that you acquire ownership of space 4 but that you have the right to convey the space to someone else. That is why you were asked to provide the Affidavit and birth certificate. Our rules and regulations require that a deed be drawn to record ownership of property. Because the property description will change from two spaces owned by Mary Elizabeth Ulmer to one space (3) owned by you to one space (4) owned by a person other than yourself it will be necessary to draw and record two separate deeds. Spaces in the Clearwater Cemetery are presently selling for $500.00 each. We recommend that you advertise the property for sale in any local newspaper. Let us know if we may assist you further. FLORIDA 34618-4748 According to our files, Mary Elizabeth Ulmer is the owner of Block 7, Lot 98, Spaces 1, 2, 3, and 4. Julius E. Ulmer is buried in space 1; Mary Elizabeth Ulmer is buried in space 2; and Hugh M. Ulmer is buried in space 3. Space 4 has no burial. The City of Clearwater Code of Ordinances Sec. 29.02 (f) states "No owner of a cemetery space shall convey, transfer or assign the space or any rights therein to a person other than the city without the written consent of the city. The form of the instrument of such conveyance, transfer or assignment shall be provided by, or approved by, the City Clerk and shall be recorded in the public records following endorsement indicating consent by the city. A request for consent to a transfer of ownership shall be accompanied by the transfer fee as provided herein and the recording fee." You may sell the property outright. In order for the sale (or transfer) of the single, unused space to be binding, we will need the original deed returned; a copy of your birth certificate showing that you are the son of Julius and Mary; and an affidavit stating that you are the sole surviving heir or a certified copy of a will naming you as beneficiary. We will also need the enclosed Cemetery Deed and Consent to Conveyance executed as indicated and returned to us along with the transfer fee of $25.00 and recording fee of $28.00 ($14.00 for single space to new owner and $14.00 for new deed covering three used spaces back to you). In addition, upon request by the owner of a space, the City may repurchase the space at the original purchase price, less the transfer fee and recording fees. We have no record of the purchase price of the property; however, it should be on the original deed. Please let us know if we may be of service in the future.
