Sand Key East: US Coast Guard West: Gulf of Mexico • Note: There is a discrepancy between the Site Data Table which gives the proposed front setback as 50' 0' and measured dimension on the site plan which gives the setback as 62'-0'. The actual setback is 62 feet and is in compliance with the setback requirements. The applicant has withdrawn the request for the two side setback variances as they are not necessary. A 12'-0' parking bonus was found to be left out of the equation which would make the required setbacks 40.25: The applicant will present a revised site plan at the public hearing which will indicate sideyard setbacks of at least 38.25: The sideyard setback variance request will then become a minor variance and wi/I be handled accordingly. 1. BACKGROUND This property is one of two remaining vacant parcels available for development on the Gulf side of Sand Key. The project was most recently reviewed by the Development Code Adjustment Board on December 10~', 1992. The site plan reviewed at that time is identical to the one that is the subject of the current application and was approved by the Board. A site plan was certified for the project and expired, which has resulted in the need resubmit the project for review. The Legal Department has reviewed the past actions and has advised that the project must also reapply for the required variance(s) that may be necessary.. On November 12t'', 1998 the Board reviewed a request on the adjacent property for a residential condominium that requested height and setback variances to allow a 235 foot tall building and to allow twelve feet side yard setbacks. This application was denied by the Board. The existing development context on Sand Key in general, and adjacent to this parcel in particular, does not meet current development standards. Many of the structures on Sand Key significantly exceed the eighty feet height standard of the current code. The Crescent Beach Club building, immediately to the north of the subject parcel is 171 feet in height, which is significantly higher than the proposed development. The Sand Key Club, which is the next VR 99-04 Page ~ development to the south, one parcel removed from the subject site, is 133 feet in height. 2. STANDARDS FOR APPROVAL/COtU9PLIANCE WITM STANDARDS: Section 45.24 of the Land Development Code sets forth the standards for approval that are to be applied to each application. The Code further requires that the application and the evidence. presented clearly support all of the conclusions enumerated below. The following is the staff's analysis of each one of those standards. (11 There are special circumstances related to the particular physical surroundings, shape or topographical conditions applicab/e to the land or bui/dings, and such circumstances are peculiar to such /and or bui/dings and do not apply genera//y to the /and or bui/dings in the app/icab/e zoning district. Nineteen buildings of twenty-one buildings surveyed on the west side of Gulf Boulevard exceed the maximum height of 80'-0". The average height of buildings, which exceed the maximum height allowed, is 156'-0". Of the twenty-one buildings surveyed twelve exceed the height requested by the applicant and average 188'-0". The property immediately to the North of the applicant's, contains two buildings (the Crescent Beach Club) each listed at 171'-0". The Sand Key Club, located two properties to the south, is 133'" feet tall. It appears that unique circumstances exist regarding the proposed parcel related to the development and urban design context on Sand Key, and the adjacent properties, that do not exist in regard to other parcels Toned high density residential in the city. (21 The strict application of the provisions of the code wou/d deprive the applicant of the reasonab/e use of the land or buildings. The applicant has a property that is capable of development without variances. However, as indicated above, the 80 feet height limitation is significant/y lower than the structures immediate/y to the north. (31 The variance is not based exclusive/y upon a desire for economic or other material gain by the applicant or o caner. The variance appears to be based upon a desire to provide a building which will be consistent and harmonious with the Sand Key Community in terms of size and scale than exclusively on a desire for economic or other material gain by the applicant or owner. The proposed building will be in scale with more than 90% of the buildings located on the west side of Gulf Blvd. on Sand Key. VH yy-V4 ~* ~ ~ Page 3 (4) The granting of the variance wi/J be in harmony with the genera/ purpose and intent of the /and deve/opment code and comprehensive p/an and wi// not be material/y injurious to surrounding properties or otherwise detr/manta/ to the public we/fare. Approval of the above variance request will not be materially injurious to the surrounding properties or otherwise detrimental to the public welfare. The granting of the variance will allow for a building which is in keeping with the general scale and size of buildings located on Sand Key. Although the proposal will not meet the specific standards of the high density residential district, the project meets the general purpose of the code to provide development in individual zoning districts that is consistent with its neighbors. 3. FINDINGS OF FACT: Based upon the documentary evidence submitted and the record created, staff makes the following Findings of Fact: • The proposed height is in scale with the adjacent structures and with the majority of structures on Sand Key; , • A variance was previously granted for the same site plan; • However, there appears to be a reasonable use of the land without the variance 4. STAFF RECOMMENDATION: Based upon the information provided above, staff recommends Denial of the variance to allow the construction of a residential condominium building with a height of 145'-0". Code of Ordinances Section 43.03 provides that "(t]hose site plans ...approved conditionally shall remain valid if a building permit is obtained subject thereto, and the project completed in accordance with such permit, within the respective allotted time periods to be specified by the ...development review committee. Extensions to the time limits imposed as a condition of site plan approval may be granted only upon written request to the development code administra#or with subsequent determination to be made by the ...development review committee...." The City's Planning and Development Services Administration concluded from a review of the certified site plan conditions and of the permit history that you had not met Condition Number 6., which required you to "obtain the requisite building permits within one (1) year from the site plan certification date to prevent expiration of the site plan certification." Nor did you submit a written request for extension of approval. I can reach no different conclusion from the information which you provided to me at our meeting. The fence permit, temporary sales trailer, and model center permits do not constitute "the requisite building permits" for the project. Nor does the payment of open spacelrecreation impact fees entitle you #o continued approval, although you may be entitled to a credit or refund in the event that the project is not constructed.
