On June 6, 1991, an application for annexation of 2.99 acres was presented to the City Commission for receipt and referral. The property is located approximately 1,500 feet north of Sunset Point Road on the west side of U.S. 19. The property in question is a part of a larger tract under several ownerships which contains 3.01 acres. The following paragraph is part of the Agenda Item report to the City Commission. "This request is for the annexation of four adjacent parcels, total area of 2.99 acres. The initial submission by the applicants was for just over three acres, which would have required the annexation request to be submitted to and approved by the State of Florida Department of Community Affairs before finalization of annexation by the city. This revised submission has excluded a sixteen foot wide strip along Lawson Ave. This has reduced the area to be annexed to just under three acres and will not require state review and approval. The developer, Whiteco Industries, Inc., has reduced the area included in this revised request for annexation in order to expedite expansion of his outside recreational facilities (Mountasia Fantasy Golf) by dealing solely with the city. Staff has advised the applicant that City Policy CC-27 encourages submission of annexation requests that contain all contiguous property under one ownership; however, the applicant has decided to proceed with the request due to time constraints. The requested Land Use Plan Amendment is from Unclassified to Commercial/Tourist Facilities and CH (Commercial Highway) zoning in conjunction with the annexation. This request does not involve a change in the Countywide Land Use Plan designation of R/O/R (Residential/Office/Retail), so no Pinellas Planning Council review is necessary." (2) Not more than one camping or travel trailer or camper truck or hauling trailer per family living on the premises shall be permitted and said trailer shall not exceed eight (8) feet in width; and further provided that said trailer shall not be parked or stored for more than forty-eight (48) hours unless it is located behind the front yard building setback line. (Code 1962, App. A, § 33.08) Sec. 131.221. Beautification plot plan. t (a) Objective. The purpose of this section is to improve the appearance of off-street vehicular parking areas in the city and to protect and preserve the appearance and value of the surrounding neighborhoods and by so doing promote the general welfare ~~~ through the installation and maintenance of landscaping for screening and aesthetic effects. , ai (b) Definitions: (1) Landscaping: Landscaping shall consist of any of the following or combination thereof: Material such as, but not limited to, grass, ground `-''~ cover, shrubs, trees and inanimate durable material commonly used in landscaping, such as rocks, gravel, sand, walls, , or fences or other landcaped materials. (2) Trees: Trees are defined as self-supporting woody plants of species which grow normally to an overall height of a minimum of fifteen (15) feet in the Clearwater area. (3) Shrubs: Shrubs required hereunder shall be self-supporting, woody evergreen species indigenuoua to the Clearwater area. (c) Landscaping requirements. All areas used for more than nine (9) vehicles of any and all types shall conform to the minimum landscaping requirements hereinafter provided, except that for ten (10) to nineteen (19) vehicles spaces: Full beautification requirements on street front, less ground cover, with some recognition for beautification in the right-of-way; half beautification requirements on nonstreet periphery; and other review through appeab, to the city manager and/or his designees. Areas used for parking or other vehicular uses for single, two-family and triplex uses when platted as individual lots are excepted from. these requirements. (1) Plan approval: Except for single and two-family dwellings, prior to the issuance of any permit for paving under the provisions of this section; a plot and planting plan shall be submitted to and be approved by the building department. The plot plari shall be drawn to scale, not less than one inch equals fifty (50) feet and on. standard sheet size of twenty-two (22) inches times 1186 °~ BUILDING AND ZONING REGULATIONS § 131.221 thirty-six (36) inches, including dimensions and indicate clearly by delineation the existing and proposed parking spaces or other vehicular use areas, access aisles, driveways, hydrants, source of water supply for planting, and the location and size of all landscape materials, including location of planting protective devices, the location and size of buildings, if .any, to be served, and shall designate planting by name (a suggested list of desirable-and undesirable plants is on file in the building department) and shall locate the plant material to be installed- or, if existing, to be used in accordance with the requirements hereof. No construction permit shall be issued unless the plot plan complies with the .provisions hereof. (2) Installation: All landscaping shall be installed per plan as approved. Property is to be inspected by building department prior to occupancy permit. (3) Maintenance: The owner, tenant or their representative shall be jointly responsible for the maintenance of all landcaping which shall be maintained so as to present a healthy, neat and orderly appearance. `,~•. (d)(,Plat,i-zaterial. Plant materials used under the. provisions of this subsection shall conform to those on the suggested list and shall meet the following requirements: is . `, (1) Trees: Species shall have trunks having clear wood of six (6) feet minimum; ~ multiple stem trees may be used. Species shall have a minimum overall height ~ _ of eight (8) feet immediately after planting. (2) Shrubs: A minimum height of eighteen (18) inches is required. If shrubs are used as hedges, a continuous unbroken visual screen should be effected upon attainment of maturity. (3) Ground covers: As a substitute for grass in all or part of the areas to be turfed, ground cover plants may be used. (4) Lawn grass: Turfed areas shall be planted with species of grass normally used for lawns in the Clearwater area. (e) Landscaping adjacent to public rights-of-way. Where an area for off-street parking will not be screened visually by an intervening building or other structure from any abutting right-of-way, excluding service alleys, landscaping shall be provided between such area acid the right-of-way. (1) A strip of land averaging five (5) feet in width, located between the abutting right-of-way and the off-street parking area shall be landscaped to include a minimum average3 of one tree for each fifty (50)~ linear feet thereof. In addition, other planting groupings shall be placed along not less than twenty-five (25) per cent of thi§ lineal frontage. If such barrier is of inanimate material, a ~ minimum average of one shrub is required or each ten (10) feet thereof planted ._. on the right-of-way side of such barrier. The balance of the required landscaped area shall be planted to grass or ground cover or other landscape ..__ treatment. ~~ ,- 1187 § 131.221 CLEARWATER CODE ~~ (2) Necessary accessways from the public right-of-way through all such landscaping will be permitted to service the parking or other vehicular use areas. (3) All property between the paved area and including the right-of-way and the ~ 1 landscaped strip (subsection (1) above) shall be turfed or planted with ground ~J cover as a minimum requirement. , (f) Landscaping relating to abutting single-family or duplex residential properties. Similar to subsection (e) above, where a parking area is not entirely screened by a building, fence or other structure from abutting residential districts, that portion of the common area not so screened shall be provided with a hedge, wall or other durable landscape barrier, not more than six (6) feet in height or less than three and one-half (3'/z) feet in height to form a continuous screen; provided such barrier is of plant material all or in part, the planting strip shall be not less than three (3) feet in width. (g) Landscaping relating to abutting multi-family, motel or professional zoned properties. Planting groupings of shrubs shall be placed along not less than fifty (50) '~ ,:lrw` per cent of the lineal feet of the property line abutting such zoning; such planting area shall not be less than three (3) feet in width or less than three and one-half (31/z) feet in ?height. " ~" (h) Parking area interior landscaping: a (1) All planting areas except those on the periphery (as described in `~~' " subsections (e) and (f) of a parking lot or area shall be raised or curbed. (See (6) below) (2) Interior of parking lots shall be planted in accordance with the requirements of ten thousand (10,000) square foot units (providing parking space for approximately thirty (30) vehicles). In each'ten thousand (10,000) square foot unit there shall be a minimum total of four hundred (400) square feet of planting area consisting of separate subareas. Each four hundred (400) square feet shall include a minimum of two (2) trees. The area for each shall not be less than five (5) feet at least in dimension. (3) The total planting area for a unit may be reduced by one hundred (100) square feet if such amount is relocated elsewhere as to emphasize an entrance corridor or feature. (4) When an interior planning area unit includes a peripheral area (as described in subsections (e~ and (f), a reduction in the planting requirement for the unit shall be proportional to the amount of the peripheral footage that is in common (coincident). _In such instance only one planting area is then required which would include the remaining separate square footage. ~ ~ •~ (5) For individual parking lots with greater than five (5) and less than thirty (30) parking spaces, a proportionate amount of the planting requirement shall be met. ~~-"'~ 1188 _.. , , w BUILDING AND ZONING REGULATIONS § 131.223 (6) In order that there shall be safe access to parking spaces, landscaped strips shall be arranged as to divide parking corridors and to limit "cross taxiing" through open parking spaces. (i) Landscaping adjacent to rights-of-way. To minimize traffic hazards, when an accessway intersects a public right-of-way or when the property abuts the intersection of two (2) or more rights-of-way, all landscaping shall provide unobstructed cross visibility at a level between three (3) feet and six (6) feet. Landscaping other than grass or ground cover shall not be located closer than three (3) feet from the edge of accessway pavement. (j) Other applicable regulations: (1) The provisions of this section shall apply to new off-street parking and to additions to existing off-street parking as required under subsection (c) above. - (2) The provisions of this section shall be subject to other applicable ~,~° regulations where such regulations are more restrictive -and are not otherwise inconsistent with the provisions of this chapter. ;i ` (3) The decision of the buildin director ma be a g y ppealed to the board of adjustment and appeal on zoning with recommendation from the beautification committee. (Code 1962, App. A, § 33.09) Sec. 13.1.222. Change of occupancy to nonresidential usage. When a change of occupancy to nonresidential usage of an existing .residential building is planned through a change of zone classification or an annexation and zoning request, the applicant shall submit with the zoning request an off-street parking plan to meet the new occupancy requirements. Such plan shall be reviewed by the traffic department prior to public hearing, and approval of the plan or required amendment shall be a condition to the establishment of the zone. (Code 1962, App. A, § 33.01.1) ARTICLE VI. DEVELOPMENT REQUIREMENTS AND PROCEDURES Sec. 131.223. Community impact statements. (a) Generally: (1) Community impact statement application for developments $1,000,000.00 or more. The initial submission by the applicants was for just over three acres, which would have required the annexation request to be submitted to and approved by the State of Florida Department of Community. Affairs. before finalization of annexation by the city. This revised submission has excluded a sixteen foot wide strip along Lawson Ave. This has reduced the area to be annexed to just under .three acres and will not require state review and approval. The developer, Whiteco Industries, Inc., has reduced the area included in this revised request for annexation in order to expedite expansion of his outside recreational facilities (Mountasia Fantasy Golf) by dealing solely with the citx. Staff has advised the applicant that City Policy CC-27 encourages submission of annexation requests that contain all contiguous property under one ownership; however, the applicant has decided to proceed with the request due to time constraints. The requested Land Use Plan Amendment is from Unclassified to Commercial/Tourist Facilities and CH (Commercial Highway) zoning in conjunction with the annexation. This request does not involve a change in the Countywide Land Use Plan designation of R/O/R (Residential/Office/Retail), so no Pinellas Planning Council review is necessary. The properties involved in this annexation request are bordered on the south by Mountasia Fantasy Golf (Whiteco Industries, Inc.). They propose to acquire the properties and develop them as an extension of their outdoor recreational facilities. The southwest portion of the subject property is presently being used by Ferrell Gas and has two, above ground storage tanks on it. The property along U.S. 19 presently has a gas station, auto repair shop, and a used auto sales establishment.
