Signs and fencing/walls are subject to separate review and permitting processes. 2. The requisite building permits must be procured within one (1) year from the date of certification of the final site plan and all requisites certificates of occupancy must be obtained within three (3) years of the date of certification of the site plan. 3. A concurrency application shall be filed and the site plan shall not be certified unless the site meets all concurrency criteria. 4. Prior to certification, the Land Use Summary shall give a breakdown into the CH and OG Districts and shall be provided in the format given on the site plan application form. 5. Prior to certification, a minimum of 30 feet from the building to the edge of pavement at the south end shall be shown on the final site plan. 6. Prior to certification, location of siamese connections to be shown on the final site plan. 7. Prior to certification, a copy of the SWFWMD permit or approved exemption application is to be provided to Engineering Site Plan Review. ~8. Prior to the issuance of a building permit, a copy of the approved SWFWMD permit is to be provided to Engineering Site Plan Review. 9. Prior to certification, the final site plan must be signed and sealed by a Professional Engineer registered in the State of Florida. 10. Prior to the issuance of a building permit, the language of the drainage and conservation easement shall be provided to the City Attorney for approval. 11. Prior to issuance of a C.O., a drainage and conservation easement shall be provided to the City over the existing wetlands area. 12. Prior to certification, Note #16 on the plan addressing sidewalks shall be modified to include Druid Road. 13. Prior to certification, all access drives to Bypass Drive shall be modified to meet the criteria and approval of the Traffic Engineer. 14. A Landscape Plan in compliance with the Land Development code requirement shall be submitted for approval by the environmental Management Group prior to the issuance of a building permit. 15. Prior to the issuance of a building permit, applicant shall acquire a clearing and grubbing permit and a tree removal permit (or a no tree verification form) from Environmental Management. .. / ~ As conditions # 3, 4, 5, 6, 7, 8, 9, 12 and 13 have been met, please certify the attached plans subject to conditions #1,2,10,11,14 and 15 listed above and distribute. Box-4748 Clearwater, Florida 34618-4748 Dear Ted: Based on our previous conversations, most recently March 5, 1992, I am providing the following written documentation for the variances being requested for the Sunset Point Shopping Center located at the northwest corner of U.S. 19 and Sunset Point Road in north central Clearwater, Florida. Additionally, Nick Zarra of our office, met with the City's Don Meerians of the Traffic Department and Alan Mayberry, City Forester, both on March 5-, 1992. Their comments and recommendations are included in the appropriate sections below. Clarke March 12, 1992 Page.2 (1) Each variance is based on prior approvals obtained over the years from the City of Clearwater. The property is unique from the standpoint that the City desires to have certain improvements 'made to the property at the same time as the developer is requesting a partial demolition and minor expansion. Beyond the initial request for lot coverage and parking variance, the extent of the variances are due to the developer's acquiescence to the City's desire to have the overall shopping center's parking lot's design improved. (2) The northern perimeter of the property, i.e. Sunset Point Drive, as well as the overall topographic grade, creates particularly difficult physical site to design to. This is in addition to the fact that the center's parking lots are existing. (3) The variances are the minimum in order to solve both (1;) and (2) state above. (4) As stated in (1) above, the request for variances is not based primarily upon the desire of the applicant to secure a greater financial return from the property. (5) The granting of the requested variances will not be materially detrimental or injurious to other property or improvements in the neighborhood. (6) The granting of the variances will not impair light or ventilation of surrounding properties, nor detract from the appearance of the community, substantially increase the congestion in the public streets, increase the danger of fire, endanger the public safety in any way, or substantially diminish or impair the value of surrounding property. In fact, the re-design of the parking lots, in part requested by the City, will reduce all such areas of concern. (7) The variance desired will not adversely affect the public health, safety, order convenience,or general welfare of the community. In fact, the re-design of the parking lots, in part requested by the City, will enhance such areas of concern. (8) Due to the small changes being requested, and supported by the documentation supplied below, the granting of the variance desired will not violate the general spirit and intent of this development code. The following documentation is provided addressing each of the three variances being sought: - Building Coverage Sunset Point Shopping Center is in reality, a high intensity highway commercial type of center. Located on the west side of Mr. Ted H. Clarke March 12, 1992 Page 3 U.S. 19 in a segment dominated by highway oriented commercial franchises and shopping centers, the center's major surrounding land use compatibility factor are the contiguous highways. The center is not located in a residentially dominated "community" which would dictate a building coverage of 25~ or less. Due to this lack of surrounding residential land uses, as well as the fact that the center is buffered from the only single family residential area on the western perimeter by a large Florida Power Transmission easement/right-of-way, (zoned P/SP), the insignificant increase of 1.58 coverage from the existing building coverage, is not an amount that would be perceptible to the general public at large. This would also pertain to the commuting traffic passing the site or the retail commercial customers who would patronize the shopping center. , It should also be noted that the slight increase of 1.58 should not dictate that the center be rezoned to a higher intensity zoning of CH (Commercial-Highway). Again, the minor nature of the variance does not warrant a major change in the zoning of the largest single commercial area in this part of the City. - Open Space The amount of open space in the "proposed" plan will be increased from the currently approved plan for the following reasons: - The currently approved plan is in excess of 13.5 below the required open spaces standard. - The revised plan will reduce the amount of parking spaces. - The re-design of the parking lots and interior landscaped islands, will increase the amount of landscaped pervious areas. { - -The additional structural addition to the existing shopping center is currently occupied by either the two- story bank building or paved parking lots; therefore; there will be no loss of existing open space. r~ Therefore, although there is still a variance in the amount of open space, the variance is less than previously approved by the City. It is important to understand, based upon counseling from the City as well as the applicant's own preference, the amount of open space has been increased as the expense of losing parking spaces. Based on Nick Zarra's meeting with Alan Mayberry of the City on March 5, 1992, he recommended the following: s? Mr. Ted H. Clarke March 12, 1992 Page 4 1. Upgrade the landscaping on all existing traffic islands: Use xeriscape planting materials such as India Hawthorne; ILex Shillings, (Holly), Juniper and Variegated Pittisporum. 2. Add more interior landscape area in association with the traffic land improvements (islands are to be added and pavement deleted). 3. Add more trees to try and approach the city's requirement of one tree per 200 S.F. of the required 6~ interior landscape area. Use trees such as Live Oak, Slash Pine; and Holly. 4. Make sure the existing irrigation system is operational and maintained. The new island landscape areas are to be irrigated. This type of increased open space at the expense of parking can also be supported by a quote from the book Carscape, A Parking Handbook, where it states: "One of the major objections to parking lots is that its bulk dominates the site because it is so much larger than the human scale. To reduce the apparent size of parking lots the landscaping elements and the screens or fences can be used to break the larger area into smaller sections. Another effective tool, one very rarely seen, is to change the usual long, linear rows of parked cars in a way that varies the circulation pattern and seemingly creates many smaller lots within. the parking area."i^1 - Parking Spaces Sunset Point Shopping.. Center is a large-sized "community/highway" serving shopping center. Square footage ranges for such a center are from 180,000 Sq.ft. to 350,000 Sq.ft. Therefore, the proposed size of 271,814 Sq.ft. is in the upper range of such centers. f~ As such centers get larger in size, and while still lacking "large draw" land-uses, the need for the standard parking ratios drops below the historic standard of 5 spaces/1,000 Sq.ft. (Large draw land uses in a commercial center such as this are movie theaters and large popular restaurants, i.e Outback.) Additionally, national trends are changing. As quoted again from the book Carscape, A Parking Handbook:. "A study done as recently as 1972 found that indeed most cities had zoning regulations covering parking and that zoning was likely to be the principal means of insuring community. Mr. Ted H. Clarke March 12, 1992 Page 5 development according to planned objectives. [^2-A] Zoning maps frequently served as substitutes for master plans. In addition, there was a trend to recLuiring a higher number of parking spaces for a criven use, and very few cities recognized the potential for joint use of parking spaces, that is, use for two activities (such as office and cinemas) whose peak demand occur at different time of the day or week. (Underline added.l Today however, we see changes towards joint usage, lower minimum- stall requirements (with areas reserved for small cars)... A 1982 Urban Land Institute report, for example, recommends from 4 to 5 spaces per thousand square feet of Qross leasable area down from its previous recommendation in 1963 of 5.5 spaces.[^2-B] This represents a savings of some 600 spaces or about 4 acres of land in a typical medium-sized center of 400,000 square feet of gross leasable area." ^2 (Underline added.) Other factors pertaining to the reduction of parking relate to the amount of open space. As elaborated earlier in this report in the "Open Space" variance section, the long unbroken distances of paving to the northeast portions of the existing lot, as well as the "unwelcome" appearance of the lot, make this area an "undesirable" lot in which to-park. Again quoting from the reference "Carscape", it states: "The single use of large areas for parking creates dead space... The problem stems from the fact that a car is so much bigger than a person. Large parking lots, while suited for cars, have the, wrong properties for people. They are too wide; they contain too much pavement; they have no place to linger. They simply do not feel comfortable on a human scale. They create a sense of isolation, and people do not feel invited to use them as public spaces . Their very size and density break the continuity of street front needed to create pedestrian traffic..." ^3 ` As mentioned earlier, in a,me~ting between Nick Zarra and the City's Don Meerians, the applicant was counseled into the elimination of a number of parking spaces to achieve a better• overall designed parking lot. ..Recommendations from Don Meerians include: 1. Create a main north/south parking traffic circulation land approximately in=the center of the parking area. 2. Open a minor north/south lane at eastern end of the project. Mr. Ted H. Clarke March 12, 1992 Page 6 3. Show the traffic striping and markings on the main entrance .pavement at the light on Sunset Point Road. These markings are to be repainted since they have faded. Additional support arguments for reduction of the parking ratio are: - Based on repeated observations, there are consistently empty parking spaces, numerous in number, in the northeast quadrant of the parking lot. - Empty unused parking spaces would be better utilized in landscape open spaces. - Such open spaces would enhance the site's capability to handle the surface drainage run-off.
