COPIES: See List Below DATE:- August 2, 1991 This memo is to serve as interpretation for Condition #2 placed upon the Certified Preliminary Subdivision Plat for the Estates of Sand Key (Certified on June 27, 1991). The condition reads; "If the location of the street requires amendment to the certified plans for Harborage I and II, the plan amendments must be certified prior to recordation of the plat. " Subsequent discussions between the City Attorney and the Director of Planning and Development determined this to be an unfair and impossible condition for the applicant to meet since the owners of the Estates of Sand Key do not own the sites of the Harborage I & II. As a compromise to this requirement, the staff will accept a revised site plan, submitted by the Estates of Sand Key owners, showing the relocation of the roadway and utility locations to serve as an addendum to this plat, thus, satisfying the intent of the requirement set forth in condition #2. Please attach this memo and this site plan to the Certified Preliminary Subdivision Plat for the Estates of Sand Key. He outlined the procedures and advised that anyone adversely affected by any decision of the Development Code Adjustment Board may appeal the decision to 'an Appeal Hearing Officer within two (2) weeks. He noted that Florida law requires any applicant appealing a decision of this Board to have a record of the proceedings to support the appeal. In order to provide continuity, the items will be listed in agenda order although not necessarily discussed in that order. I. Public Hearings .ITEM A - (continued from 6/14/90) American Diversified Capital Corporation for a variance of 22 ft in height to allow homes up to 47 ft in height at 1611 Gulf Blvd,., Sec 30-29-15, M&Bs 11.01, 12.01 & 12.03, zoned RM-28 (multiple family residential) per RS-8 (single fetnily residential). V 90-89 The Planning Manager explained the application in detail, stating staff is recommending going through the Residential Planned Development (RPD) process rather than the variance process due to .the wide deviation between the request and the code requirements. He indicated the subject property would support five 80-foot buildings for a total of 336 units. If developed as single family., the Code provides for development under RS-8 which has a 25 foot height limitation. In response height measurement which would result 43 feet high. to a question, the Planning Manager indicated the actual is calculated 4 feet down from the peak of a pitched roof, in a variance request of 18 feet in height to allow a house DCAB 1 7/26/90 George Greer, attorney representing Martin Enterprises, Inc., the new owner, distributed an aerial photo showing the proposed subdivision is surrounded by high multi-family structures. The developer is proposing 36 single family lots, thus foregoing 300 additional housing units in this zoning. He indicated a hardship exists in being in a flood zone area which requires an increase of 4 feet in height. He felt the request was reasonable and would not set a precedent due to the unique features of the property being on the water and surrounded by high rise structures. In response to a question he indicated the lots would be approximately 90 feet x 120 feet with a floor area of approximately 5,000 to 6,000 square feet. A representative of Harborage II spoke and submitted a letter~in support of the application indicating an agreement had been reached with the developer on all issues of concern. Two letters of opposition were submitted for the record. In response to a question, it was indicated individual builders would be engaged. Concern was expressed regarding approving a "blanket" variance as it was felt other variances, particularly variances for side setbacks, would be needed due to the lot size and the type of homes proposed to be built. Discussion ensued regarding the Board's policy of having a site plan supporting the variance request and to viewing each request individually. Also, it was felt there were alternatives to developing this site. Mr. Greer indicated the project has already been delayed approximately 6 weeks and going for a rezoning would cause an additional delay. He said the developer could stipulate a 7-1/2 foot setback as part of the deed restrictions. Discussion ensued in regard to whether or not this was a minimum request. A copy of a plat showing the lot layout was distributed to the Board. Concern was expressed regarding odd shaped lots presenting a problem in regard to setbacks. Discussion ensued in regard to the RPD process being the correct process to follow calling for less stringent limitations. Mr. Greer indicated his client would be willing to accept a 9 foot side setback. Concern was expressed that the builder who builds a lower house would be penalized by imposing a 9 foot side setback restriction. DCAB 2 7/26/90 1 t 1 ~r Based upon the information furnished by the applicant, Mr. Plisko moved to rg ant a variance of 18 feet in height to allow homes up to 43 feet in height from grade because the applicant has substantially met all of the standards for approval as listed in Section 137..012(d) of the Land Development Code, it arises from a condition which is unique to the property and the particular physical surroundings, being the 80 foot high condominiums in relationship to the development, subject to the condition that the side setbacks shall be 9 feet on all parcels within the development. The motion was. duly seconded and carried unanimously. Motion carried. Request granted. In response to a question, it was indicated the 18 foot variance includes the height bonus. ITEM B - (continued from 6/14/90 and 6/28/90) Jack E. and Erin L. V 90-87 The Planning Manager reported the applicant has withdrawn this item due to Commission policy CC-31, adopted January, 1990, directing staff to not accept any application for variances to residential planned development setbacks for enclosures. ITEM C - (continued from 7/12/90) Virginia M. Wynne for a variance of 18 in. to permit a 48 in. high fence in setback area adjoining ly;~~~ a street right-of-way to which property is addressed at 830 Bruce Ave., Mandalay Sub, Blk 17, Lots 3-4 and 9-11, zoned RS-8 (single family residential). V 90-103 The Planning Manager stated the applicant is requesting to enclose a recently installed inground swimming pool/spa. James Van Kleeck, representing the applicant, stated the request has been modified to a variance of 6 inches in height to permit a 36 inch high fence. The fence will be only on the north side (Bruce Avenue) of the property. In response to questions, he stated a 36 inch high fence will meet insurance company requirements and will be located as indicated in the application. Based upon the information furnished by the applicant, Mr. Plisko moved to grant a variance of.6 inches to permit a 36 inch high fence because the applicant has substantially met all of the standards for approval as listed in Section 137.012(d) of the .Land Development Code, it arises from a condition which is unique to the property and was not caused by the applicant and it. is the minimum necessary to overcome the unnecessary hardship, subject to the condition that a fence permit be obtained within six (6) months from this date. W I T N E S S E T H: WHEREAS, Harden is the owner of the property described as The Estates of Sand Key upon which it proposes to develop 36 luxury, single-family residential building sites, said property being hereinafter referred to as the "Estates"; and WHEREAS, the Harborage Association is the non-profit corporation responsible for the operation and management of The Harborage Condominium, hereinafter referred to as "Harborage", said Condominium being further described pursuant to that certain Declaration of Condominium recorded in O. R. 5307 beginning at Page 1506 of the Public Records of Pinellas County, Florida; and WHEREAS, the Harborage II Association is the non-profit corporation responsible for the operation and management of the Harborage II Condominium, hereinafter referred to as "Harborage II", said condominium being further described pursuant to that certain Declaration of Condominium recorded in O. R. Book 5461 beginning at Page 1213 of the Public Records of Pinellas County, Florida; and WHEREAS, ingress and egress to and from Harborage and Harborage II and. the water, sewer and other utility lines that supply water, sanitary sewer facilities and other utilities to Harborage and Harborage II run over, across, under and through the Estates as well as the condominium property of The Isle of Sand Key Condominium 1, the condominium plat thereof being recorded in Condominium Plat Book 19, Pages 86 through 90 of the Public Records of Pinellas County, Florida, hereinafter referred to as the "Isle of Sand Key"; and WHEREAS, as part of the development of the Estates property, Marden will relocate the road, water and sewer lines and other utilities that provide utility service and ingress and egress to, from and for Harborage and Harborage II; and WHEREAS, located on the Isle of Sand Key property is a guard house which provides security for ingress to the Isle of Sand Key, Harborage, Harborage II and the Estates; and WHEREAS, it is in the best interest of the residents of the Isle of Sand Key Condominium, Harborage, Harborage II and the Estates to enter into an agreement for the allocation and sharing of expenses for security, the sewer lift station, maintenance of roads and lighting expenses that are used in common; and WHEREAS, certain submerged lands that are owned by Marden and adjoin the property owned by Harborage and Harborage II are improved with boat slips utilized by Harborage and Harborage II residents respectively; and WHEREAS, the Associations and Marden desire that the common boundaries between the Estates, Harborage and Harborage II be delineated by a wall to be located on Harborage and Harborage II property of a design, location and material satisfactory to Marden and the Associations; and , WHEREAS, the relocation of the ingress and egress roads will require relocation of parking for Harborage and for Harborage f II, redesign of existing retention ponds for Harborage and Harborage II and relocation of a tennis court for Harborage, but with no, loss of total parking for either Harborage or Harborage II. NOW, THEREFORE, for good and valuable consideration, the receipt of which is hereby acknowledged and the mutual covenants and promises contained herein, the parties hereto agree as follows. 1. The above recitals are incorporated herein as true and correct. 2. Marden agrees to commence construction of a new road, drainage system, water lines, sewer lines and other utilities across, over, under and through that portion of the Estates described in Exhibit "A" attached hereto ("New Easement Area"). Said construction shall be pursuant to the proposed site plan on file with the City of Clearwater for the Estates and shall comply with all plans and specifications to be filed with and approved by the City of Clearwater. 3. Upon completion of the construction contemplated in Paragraph 2 above, Marden agrees to grant and convey to the Associations, their members, the owners, guests, licensees, invitees and tenants of condominium units in Harborage and Harborage II together with the holders of mortgages thereon a nonexclusive easement for ingress and egress and utilities over and across the New Easement Area ("New Easements"), with said easement to run with title to the ownership of Harborage and Harborage II properties as a benefit thereto and as an encumbrance to the ownership of the New Easement Area. 4. The Harborage Association and Harborage II Association agree to execute simultaneously on behalf of themselves and all of the owners of condominium units within Harborage and Harborage II, a Release and Vacation of those easements described in Exhibit "B" attached hereto ("Old Easements") with respect to the Estates property, but not with respect to the property of the Isle of Sand Key. 5. Upon execution of the New Easements and release, o.f the Old Easements, Marden, Harborage and Harborage II shall enter into an agreement with themselves and the Isle of Sand Key Condominium 1 Association, Inc. to share in the cost of security and maintenance of the roads, the sewer lift station and street lighting thereon so that the expenses are allocated on the basis of having each lot in the Estates and each unit in a condominium development pay the same amount provided, however, that the expense for the roads, street. lighting and sewer lift station located on the Estates property shall be shared only between the owners of lots in the Estates, the owners of units in Harborage and Harborage II and that the owners of condominium units in .the Isle of Sand Key shall have no responsibility therefore. 6. Subject to the approval of the City of Clearwater, Marden agrees to install a wall and illuminated pillars with a sign at the common boundary between the Harborage property and the Estates property and at the common boundary between the Harborage II property and the Estates property, with said installation to be at the expense of Marden and on the property of Harborage and Harborage II, respectively. If installation of a wall is not approved by the City of Clearwater, then Marden, in lieu of a wall, shall install landscaping to delineate the common boundaries between the Estates, the Harborage and Harborage II, respectively and if approved by the City of Clearwater, shall install illuminated pillars with a sign on each side of the entrances tb the Harborage and Harborage II. Subsequent to the installation of said wall, pillars or landscaping, the same shall be maintained by each Association as originally installed. 2 7. Upon construction of the roads and other improvement contemplated by the granting of the easements described in Paragraph 3 above, Marden agrees to re-stripe additional parking on ,the Harborage and Harborage II parking lots, expand the retention ponds located on the Harborage and Harborage II properties and relocate the tennis court of Harborage, as described in Exhibit "A". In addition, Marden shall restore all landscaping and irrigation that may be damaged or uprooted by the aforementioned work to its original standard and Marden agrees to indemnify and hold harmless the Associations from and against and be responsible to cure any damage that may be caused to their respective properties by the work performed under this paragraph. Upon completion of this work by Marden, each Association shall grant the Estates a perpetual drainage easement in and through the expanded retention ponds of their respective properties as said ponds are depicted on Exhibit "A". Parking shall be prohibited in and over the retention pond located on the Estates property adjacent to the Harborage II entrance. Furthermore, Harborage II Association shall have the right to maintain said pond, including landscaping in accordance with the surrounding area. 8. Marden agrees to commence construction. of the roads and utility improvements as soon as possible and to complete construction of the walls, expansion of retention ponds, re- striping of parking areas and installation of landscaping as soon as possible after completion of the road and utility construction with the expectation that all construction and work shall be performed concurrently where possible and completed simultaneously where possible. 9. Upon granting of the New Easements, release of the Old Easements and the release from the lien of any mortgage thereon, Marden agrees to convey title to the Harborage Association and the Harborage II Association, respectively to the submerged lands adjacent to the property owned by Harborage and Harborage II, beginning at the existing docks and proceeding West for Harborage and South for Harborage II along the seawall in an area which extends from the seawall into the submerged lands a distance of 36 feet. Said conveyance shall be by Quit Claim Deed with no warranties of title. Between granting the New Easements and releasing the Old Easements and conveyance of title to the submerged lands previously described, each Association may manage and control the boat slips located over that portion of the submerged lands intended to be conveyed to their respective Associations. 10. The grant of the New Easements and the release and vacation of the Old Easements shall be made when Marden completes construction of the road improvements, walls, landscaping and 'utility improvements contemplated herein. 11. If Grantor shall deem relocation of the Easement to be advisable it may do so by written amendment hereto executed solely by Grantor and recorded in the Public Records of Pinellas County, Florida. The relocated easement shall confer upon Grantee the same rights and easements over the relocated easement property and shall be of the same width as granted herein. Upon relocation of this easement, all easements and rights with respect to the property upon which the easement originally existed shall cease and be of no further effect. 12. If the terms of this agreement have to be enforced by either party, the prevailing party shall be entitled to recover the cost of said enforcement which shall include but not be limited to attorney fees, whether before or after litigation commences, and through appeal and paralegal expenses. 13. Harborage Association. and Harborage II Association agree to support the request of Marden pending before the City of 3 1 t Clearwater for a height variance to allow construction of single family residences forty seven feet above grade on the Estates property. 14. The terms of this agreement shall be binding upon the heirs, successors and assigns of the parties hereto. They have serious navigational concerns with any dock construction at Parcels 1, 2, 3 and 4 at The Moorings of Sand Key. They claim they were never received notification about public hearing on the site plan for The Moorings of Sand Key. In the site plan for The Moorings of Sand Key, there is no dock approved for Parcel 1. Parcel 2 and 3 will share one dock that joins both properties. Parcel 4 is a regular 30 foot dock constructed off the property. After meeting on Sand Key, I feel in the areas off any docks at the approval from my plan for the doc] not approve them site with the representatives from the Isle of they have a legitimate concern about navigating the above mentioned parcels. Prior to building parcels, the marine contractor must have office on the dock construction permit. As the cs at these parcels is presently designed, I will because of navigational problems. The developer for the Moorings of Sand Key should be advised that dock construction at Parcels 2, 3 and 4 will need to be eliminated or greatly reduced. Signs and fencing/walls are subject to separate review and permitting processes. 2. The requisite initial building permit must be procured within one (1) year from the date of certification of the final site plan and all requisites certificates of occupancy must be obtained within three (3) years of the date of certification of the site plan. 3. The related final plat shall be recorded within one (1) year from the certification date of the preliminary plat or prior to issuance of a certificate of occupancy, whichever comes first. 4. The dates and conditions for approval by the Planning and Zoning Board for plan development approval and the Building and Flood Board for variance approval shall be provided on the preliminary plat/site plan prior to certification. 5. A note shall be included on the plat and site plan indicating that each individual owner is responsible for the seawall fronting their property. 6. Prior to certification, maintenance easements for the seawall shall be shown. 7. Prior to certification, building within 18 feet of the seawall shall be approved by the Building Official or the Building/Flood Board. 8. Prior to certification, a letter from the Building Official shall be filed with the City verifying approval of all buildings within 18 feet of the seawall. 9. Sidewalks are required adjacent to all street rights-of-way with no sidewalk bond required. 10. Prior to certification, street names shall be shown as remaining the same as shown on previous plat. 11. Prior to issuance of a building permit, all docks and dock locations shall be approved by the Harbormaster. 12. The applicant shall contact Parks & Recreation for the required recreation/open space assessment fee, which shall be paid prior to certification. (c) Improvements to be constructed in, on and over the Sub- merged Lands and surface waters between the easterly boundaries of Parcels 2 and 3 and the westerly boundary of Parcel 4A shall not extend into or obstruct a channel-one hundred (100) feet in ciidth, lying -4- .: fifty (50) feet on either side of the centerline of the parcel of the Submerged Lands and surface waters lying between said boundaries. ~(d) Except for emergencies, no boat shall be moored or berthed at any time in any manner. that would cause such boat to obstruct or other~eise unreasonably interfere with navigation in the channels provided for in (b) and (c) above. 3. GOVERNMENTAL. REQUIREMENTS All improvements to be erected by either party in, on or over the Submerged Lands shall conform to the requirements of all govern- mental authorities having jurisdiction over such construction in accordance with all permits required by such governmental autho- rities. 4. GENERAL PROVISIONS (a) Each party shall pay all costs to the construction by such party of the improvements contemplated in this agreement and all costs of operation and maintenance of such improvements constructed by it. All construction, maintenance and operation of such facili- ties shall be in good taste and in accordance with all applicable laws, ordinances and governmental regulations. (b) Upon commencement of construction of .improvements and there- after, the party constructing and thereafter maintaining and operating such facilities shall r.a.rry and keep in full force and effect policies of public liability insurance covering such construction, maintenance and operation. (c) Nothing in this agreement shall prevent either party from storing, selling and dispensing fuel for boats, including gasoline and diesel fuel, from facilities constructed, maintained and operated by such party in the submerged lands, provided any such storage, sale and dispensing is conducted in accordance with all applicable laws and governmental regulations and in such manner as to not present a hazard to person and/or property~of any other persons or parties. ~~(d) Subject to the respective rights of the parties to construct, maintain and use improvements in, on and over the Submerged~Lands and surface waters as provided in this Agreement, either party hereto and their respective successors and assigns shall be entitled to provide -5- o. ~. r~~~~ e~c~l~~~ • ~ d 'b d hannels and basins and such other and maintain the above- escri e c channels and/or basins as the parties may. from time to time deem appropriate to provide navigational access to other improvements constructed .in accordance with this Agreement in, on and over the Submerged Lands and surface waters covering same sufficient for the navigation of boats to and from the facilities now or hereafter erected by such party. or parties, including the right to dredge, provided that all such dredging and other maintenance shall (i) be conducted in strict accordance with all applicable governmental requirements and (ii) shall not unreasonably interfere.on either a temporary or permanent basis with the rights of other parties in the Submerged Lands and surface waters covering same or the use or enjoyment of improvements of such other parties in, on and over the Submerged Lands. Each party shall bear the cost of all dredging L and maintenance which .it requires, unless the parties shall hereafter agree to share such.~costs in a mutually. satisfactory manner. .
